On the death of the beneficiary, that trust pours over into a charitable remainder and the family gets nothing.

What Fernando was after was the gap.

When a minor beneficiary dies, the trust does not simply close.

There is a period — probate of the child’s estate, accounting, the discharge of the trustee, the resolution of any claims — and that period runs for months and in a contested matter for years.

And during it, the surviving parent, as administrator of the deceased child’s estate and as the party with standing, has a right to petition for an allowance from accrued income to meet the administrative and final expenses of the estate.
