The Kennewick Man was eventually dated to approximately 8,500 years before the present — making him substantially younger than the Spirit Cave Man but still among the oldest human remains ever found in North America.
The local Umatilla and other Columbia Plateau tribes immediately claimed the Kennewick remains under NAGPRA, requesting repatriation.
A group of scientists sued, arguing that NAGPRA did not apply to remains this old, that the potential scientific value of the remains was too great to allow repatriation without full study, and that the skull morphology suggested the remains might not be Native American in the sense that NAGPRA intended.
