The Oglala Lakota Tribe now has legal authority over the Pine Ridge Reservation.

If the burial is on reservation land, the tribe has jurisdiction over it.

This means that if the burial site were known, the tribe would have legal standing to protect it under NAGPRA and other relevant laws.

The question of whether disclosing the site to tribal authorities — even without public disclosure — would enable better protection is one that the community must answer for itself.
