Created by Congress in 1946, the Commission had a specific and somewhat ironic mandate.
Congress established it partly out of genuine concern for unresolved tribal grievances and partly because clearing the backlog of Indian claims against the government was understood to serve federal interests as well as tribal ones.
Unresolved claims created legal uncertainty and political liability.
The Commission was meant to provide a forum in which claims could be heard, assessed, and resolved — with “resolved” generally meaning the award of monetary compensation.
The Commission was not designed to award land.
Its tools were monetary.
