the fourth day and I did not open it for eleven months.

That is the beginning, and everything else in this account comes out of the eleven months, because if I had opened it in the room I would have known inside forty seconds and my whole life would have been a different shape.

It was cardboard.

About the size of a shoebox, covered in a patterned paper — small blue stars on cream — that I later learned is bought in bulk by the hospital’s auxiliary and assembled by volunteers on Tuesdays.

She put it on the tray table beside my bed and she put her hand flat on the lid for a second before she took it away, which is a thing I have thought about a great deal since.

Her name was Bernadette Kaur.

She was a NICU nurse and I had never seen her before in my life and I would not see her again for four years.

She said: “This is for you.

It’s from all of us upstairs.

There’s no hurry with it — some people open it in the room and some people open it in ten years and both of those are all right.”

And then she said one more thing, and it is the only sentence anybody said to me in that hospital that was not a lie or a kindness built on top of one.

She said: “Mrs.

Renfrew, whenever you do open it, I’d like you to read the card first.

Before anything else in the box.”

I said something.

I do not know what.

I was four days out from an emergency cesarean and three days out from being extubated and I was on a great deal of medication, and my husband was standing at the foot of the bed with a cup of coffee, and I had been told that one of my sons had died during delivery.

Davis said, “That’s so kind.

Thank you.”

And he took the box off the tray table and put it in the bag by the window.

I want to be exact about that, because for a long time I made it into something it was not.

He did not snatch it.

He did not look alarmed.

He picked up a box that was sitting where my water needed to go and he moved it, the way you move a thing, and he said thank you to a nurse, and she looked at him for about a second and a half and then she left.

I have watched that second and a half in my head perhaps a thousand times.

She knew.

She had come down from the NICU with that box specifically, off her own floor, on her own initiative, and she had told me to read the card first, and then a man moved it into a bag and she made a decision in a second and a half that I have never once blamed her for.

She was twenty-nine years old.

She had been a nurse for four years.

What she had was a suspicion about a colleague’s patient’s family, no standing, no evidence, and a woman in a bed who had been off a ventilator for three days.

She said one sentence.

It was the right sentence.

It was, in the end, enough.

It just took eleven months.

The box went home in a bag and the bag went in the closet of a room we did not go into, and then in the August it went into a plastic tub when we moved, and then it sat in a garage in a house in Middleton, Wisconsin, for another five months.

I opened it on the twenty-eighth of February, three days before my son’s first birthday, at about eleven at night, sitting on the floor of a garage with a glass of wine, because I had decided that morning that I was going to be a person who could do that.

Inside there was a knitted hat, cream, about the size of an orange, made by somebody in a church group in Sun Prairie who I have since found and written to.

A small sealed envelope with a lock of dark hair in it.

Four photographs.

A length of ribbon with a length marked on it in pen.

And a card.

Heavy paper, folded once, with two footprints on the front in dark blue ink, very small, the toes not fully separated the way they are.

Under the footprints, printed in a careful hand:

Linus fourth of March.

My sons were born on the second.

Part Two: What I Was Told

I am going to set out the version I was given, in full, because I lived inside it for eleven months and because the accuracy of the lie is the most frightening thing about it.

Nobody told me a story.

That is the thing people get wrong.

There was no speech, no fabricated scene, no details has seams.

What I got was eleven words on the third of March and then four years of everybody in my life being extremely careful.

I woke up intubated on the third and was extubated that afternoon, and at some point that evening — I do not have a clean memory of this and I have stopped trying to produce one — my husband sat on the edge of my bed and held my hand and said:

“They couldn’t save him.

I’m so sorry.

They did everything.”

That is it.

That is the entire fabrication.

Six words and then five.

They couldn’t save him. True, in the sense that they could not.

They did everything. Also true.

They did more than everything.

There is a forty-page section of a chart that I have now read that establishes it beyond any question.

Not one word of what Davis Renfrew said to me on the evening of the third of March was false.

And the sentence I heard was: your son died during the delivery.

I want to be honest that I built that.

He did not put it there in so many words.

I was thirty-three years old, four days into the worst thing that had ever happened to me, on hydromorphone, and I heard eleven words in a hospital bed and I constructed a fact out of them, and then I lived in it.

And for four years, every single person in my life who knew otherwise simply did not correct me.

That is the mechanism and it is not dramatic and it is available to absolutely anybody.

You do not have to lie to somebody.

You have to let them build a wrong thing out of true materials, and then not mention it, and then keep not mentioning it, and after a while the not-mentioning becomes its own structure and you could not dismantle it if you wanted to.

Here is who knew.

My husband, Davis Renfrew, thirty-five.

My mother-in-law, Lorna Renfrew, sixty-four.

And in a different category entirely, which I will come to: an attending neonatologist, three fellows, about eleven nurses, a palliative care physician, a clinical ethicist, a social worker, a chaplain, and a bereavement coordinator, every one of whom believed — correctly, on the information they had — that the patient’s husband was handling communication with the patient, because that is what he told them.

Nobody at that hospital did anything wrong.

I want to say that at the front and I will say it again at the end.

I have gone through eleven hundred pages looking for somebody to blame and the only person there is is the one who was sitting on the edge of my bed.

My sister Vesna did not know.

My parents did not know.

And for eleven months, neither did I, and I went to a grief group on Thursdays, and I told about fourteen people over the course of that year that my son had died in the delivery room, and every single one of those sentences is out there in the world and cannot be recalled.

That is the part that gets me at two in the morning.

Not the box.

Not the date.

The fourteen people who were kind to me about a thing I had wrong.

Part Three: The Second of March

I have almost nothing of it and I have made my peace with that, more or less, with help.

What I have is this.

I was thirty-eight weeks and one day with di-di twins.

It had been an entirely unremarkable pregnancy — I had a scheduled cesarean on the books for the eighth, I had taught a full day of chemistry on the first of March, I had a bag by the door.

On the afternoon of the second of March I was in the kitchen of our apartment in Madison, and something happened in my abdomen that I am not going to describe, and I was on the floor, and Davis was home because it was a Tuesday and he works from home on Tuesdays.

He called 911 at 4:08.

I have that from the record, not from memory.

I remember the hallway of the apartment building.

I remember a man’s voice saying a number twice.

I remember being cold in a way that had nothing to do with temperature.

And I remember, very clearly and with no context at all, a woman saying, “Thea, I need you to look at me.”

That is the last thing.

Everything after that is a document.

What the document says is placental abruption with maternal hemorrhage.

What it means is that the placenta separated from the wall of my uterus before the babies were delivered, and that I lost a great deal of blood very quickly, and that both of those facts had consequences for three people.

I was taken to the operating room and put under general anesthesia — not a spinal, which is what you have for a planned cesarean and which is why people are awake for them, but general, because there was no time — and my sons were delivered at 5:41 and 5:42 in the evening.

I received seven units of packed red cells and four of plasma.

I was in that operating room for two hours and eleven minutes.

I went to the intensive care unit intubated and I stayed there for thirty-one hours and I was extubated on the afternoon of the third.

Twin A came out in poor condition and recovered quickly.

He was in the NICU for nine days for observation and feeding and he came home on the eleventh of March and he is four years old now and he is in every respect a completely ordinary, healthy, extremely loud four-year-old.

Twin B came out in very poor condition.

I am not going to write about the fifteen minutes that followed, in any detail, ever.

I have read those pages four times and I am not going to reproduce them and if you want to know what happened in them, they are the standard pages and they are in every account of this that has ever been written and I decline to put my son in one.

What I will write is the outcome, because the outcome is the story.

He was resuscitated.

He was stabilized.

He was taken to the neonatal intensive care unit at 6:29 in the evening on the second of March, one floor above the room where I was, and he was started on therapeutic hypothermia — cooling — which is the treatment for what he had, and which has to be started within six hours, and which was started within forty-eight minutes.

He was alive for fifty-one hours.

He died at 9:52 in the evening on the fourth of March.

I was one floor below, awake, on a regular postpartum floor, in a room with a window, having been extubated for thirty-one hours.

People ask — kindly, and they cannot help it — whether I felt something.

Whether at 9:52 on the fourth of March there was a moment.

There was not.

I have gone back to it with a therapist about nine times looking for one, because I wanted one very badly for about two years.

There is nothing there.

I was awake at 9:52 on the fourth of March and I was watching something on a tablet and my husband had gone down to move the car.

I was probably annoyed about the parking.

Part Four: The Eleven Months

I grieved for eleven months and I grieved the wrong thing, and nobody ever explains what that costs, because almost nobody has to do it.

Here is what I mean.

For eleven months I was the mother of a stillborn son.

That is a specific thing with a specific shape.

It has its own literature and its own groups and its own vocabulary.

The central fact of it is that there was never a living person — that the loss and the birth are the same event, and there is nothing before and nothing after, and the work is to grieve somebody you never met.

I was good at it.

That is a strange thing to say and it is accurate.

I went to a group on Thursdays for nine months.

I read four books.

I did the thing they tell you to do, which is to say his name out loud regularly, and I said it in the car about two hundred times.

And the thing I built, over eleven months, was an idea of a boy who had never been anywhere.

That is the phrase I used, in my own head, dozens of times. He was never anywhere. It was a comfort.

It meant he had not been frightened, and had not been cold, and had not been alone, and had not waited for anybody, because there had been no him to do any of those things.

I built eleven months of structure on that and it held me up.

And on the twenty-eighth of February I sat on a concrete floor and found out that my son had been somewhere.

He had been in a room, one floor above me, for fifty-one hours, with lights and noises and people’s hands on him, and a cooling blanket, and a nurse called Petra writing settled at four in the morning.

Dr.

Adisa has a phrase for what that did and she gave it to me in about our sixth session and I have used it since with two other people.

She called it a demolition.

She said: “Grief builds a structure.

It’s not a metaphor — it’s what the work is.

You build a version of the person and a version of what happened and you attach yourself to it, and that is what lets you stand up.

“You spent eleven months building one.

You did it properly, with support, and it was load-bearing.

“And then you found out it was built on a fact that wasn’t true, and the whole thing came down in about forty seconds on a garage floor, and you had to start again from nothing at a point when most people are stabilizing.

“Thea, you did not have one bereavement.

You had one, and then you had it demolished, and then you had a second one that included the demolition.

That is why the second year was worse than the first and it is not a failure of yours.”

The second year was worse than the first.

I want that written down plainly, because everybody assumes the first year is the bottom, and for me it was not, and I have since met two other people for whom it was not, for entirely different reasons.

And there is a specific cruelty inside it that I did not anticipate at all.

For eleven months, the thing that had comforted me most was that he had not been alone.

That was the load-bearing piece.

There had been no him, so there had been no loneliness, so there was nothing to have failed at.

And what I got on a garage floor was fifty-one hours in which there was a him, and in which he was in a room without his mother, and in which a great many kind and competent strangers did everything for him that I should have been doing.

I have had to be walked away from that particular sentence about nine data-onpage="true" data-adpath="/22756311368/LaptopsVilla/Blog_InContent_77">

I did not go inside.

That is the single most consequential thing I have ever done and it took me four hours to not do it.

Here is what four hours of that is actually like, because I have read accounts of moments like this and they are always compressed into a paragraph and it is not a paragraph.

The first thing is that you do not believe the date.

For about twenty minutes I sat on a concrete floor holding a card with two footprints on it and worked extremely hard on the theory that a volunteer had made a mistake.

I looked at the ribbon.

The ribbon had a length on it — nineteen and a quarter inches — and a date, and it was the same date.

I looked at the four photographs.

I had never looked at them.

I had never seen a photograph of my son.

In three of them he is being held and there are hands and part of a shirt and I did not, that night, register whose hands they were, and about four months later I did, and that was its own evening.

The fourth one is just him.

I sat on a floor for about forty minutes with that photograph.

The second thing that happens is that your body decides before your head does.

Somewhere around midnight I stopped constructing theories about volunteers and my chest went and I was on my side on a concrete floor making a noise I did not know I could make, with a glass of wine tipped over and a dog scratching at the door from the kitchen side.

And the third thing — and this is the part I want to put down carefully, because I think it is the only useful thing in this entire account — is what happened at about one in the morning.

Everything in me wanted to go into that house and up those stairs and wake him up.

I had it planned.

I had the card in my hand and I was going to put on the light and hold it in front of his face and say what is this.

I got as far as the door to the kitchen twice.

What stopped me was not nobility and it was not strategy.

I am a chemistry teacher.

What stopped me was a thing I say to sixteen-year-olds about four hundred times a year, which came into my head at one in the morning in a garage completely unbidden, in my own voice, in the tone I use in a classroom.

Don’t ask a question you can’t measure the answer to.

Because here is what would have happened.

I would have woken him up and held a card in his face and he would have talked.

He would have talked very well.

He is good at it.

He has spent fourteen years in insurance claims, which is a profession that consists entirely of explaining bad outcomes to people in a way that does not produce a lawsuit, and he is extremely good at his job.

And he would have been frightened, and a frightened man talks fast, and by about four in the morning I would have had a version.

And it would have been a good version.

It would have had true things in it.

It would have had his grief in it, which is real, and it would have had the word protect in it, and by breakfast I would have been the one apologizing for the shouting.

And every single thing I found out afterward would have arrived pre-explained.

That is the thing.

Once a person has given you a version, you cannot un-receive it.

Everything you learn afterward gets sorted into it, and the version survives almost anything, because it got there first.

So I did not go inside.

I put the hat and the hair and the ribbon and three of the photographs back in the box.

I kept the card and the fourth photograph and I put them in the glove compartment of my car under the manual.

I put the box back in the plastic tub and I put the tub back where it had been, in the same orientation, and I wiped up the wine.

And at about three in the morning I went upstairs and got into a bed next to a sleeping man and lay there until about five.

And at eight o’clock in the morning I made pancakes, because it was a Saturday and it was three days before our son’s first birthday and his cousins happened rests on it.

What my son had is called hypoxic-ischemic encephalopathy.

It means brain injury caused by an interruption in oxygen and blood flow.

In his case the cause is not in dispute: the placenta separated, and for a period of time before he was delivered he did not have what he needed.

It is graded I, II and III.

He was III.

The treatment is therapeutic hypothermia.

You cool the baby to about 33.5 degrees for seventy-two hours, which slows the secondary cascade of injury that happens in the hours and days after the initial event.

It is one of the genuine successes of modern neonatology.

It works.

It does not work for everybody.

For grade III, the published outcomes are hard reading.

Cooling improves them substantially and they remain, in the honest phrasing of the literature, poor.

I read about forty papers between the July and the October.

I am a chemistry teacher; reading papers is a thing I can actually do, and I did it in the evenings for four months while a man slept upstairs.

Three things determined my son’s prognosis and I want them on the record in the order they arrived.

The first was the continuous EEG, which ran from the night of the second.

It did not show what you want it to show.

For grade III, a persistently abnormal background at forty-eight hours is one of the strongest predictors there is.

The second was the clinical examination, which did not change across two days. No interval said: “Do you want the translation or do you want it straight?”

I said straight.

And she said: “There was no version of this where your son came home and grew up.

There is no hospital in the world and no amount of money that changes that report.”

I asked whether he could have lived.

She said: “In the sense of a heartbeat and a ventilator — yes, possibly, for some period.

Weeks.

Possibly longer, with a tracheostomy and a feeding tube, in an institution or at home with round-the-clock nursing, with no awareness of any of it and with seizures that are very difficult to control.

“That is a real option and some families choose it and I have taken care of those children and I do not judge one single parent who chooses it.

“It is not what was recommended and it is not what most people choose, and the recommendation your family was given was, in my professional opinion, correct.”

I sat with that for about a week.

Here is what I have arrived at, four years later, and it has not moved in three of them.

Dr.

Constance Ubaldi did her job properly.

Warren Tso did his job properly.

The palliative team did their job properly.

The recommendation made in a conference room at 11:30 in the morning on the fourth of March 2021 was medically sound, ethically sound, and — I believe, and it has cost me a great deal to be able to type this — right.

And none of that is the point.

That is the thing I have had to explain to about nine people, including, for a while, my own sister.

People hear that the decision was correct and they think that settles it.

They think that if the outcome was going to be the same, then what was taken from me was a formality.

What was taken from me was fifty-one hours.

Not a choice.

I do not believe I would have chosen differently and I will get to that, because it is the hardest part.

Fifty-one hours in which my son was alive, one floor above me, and I could have been in the room, and I could have put my hand on him, and I could have been asked, and I could have said yes, and I could have held him for two hours and twelve minutes on the evening of the fourth of March.

There is no medical argument that touches any of that.

The rightness of the decision and the theft of the fifty-one hours are two entirely separate things and everybody who tries to use the first to settle the second is doing something I have had to learn to interrupt.

Part Ten: What He Signed

The consent document is one page.

It is a standard form.

There is a box for the patient’s name, which has my son’s medical record number in it because he did not have a legal name yet on the morning of the fourth of March.

There is a paragraph of text.

There is a line for the relationship of the person signing.

On that line, in my husband’s handwriting, it says: Father.

And there is a signature, and the signature is his, and the time is 1:50 p.m., and it is countersigned by Dr.

Ubaldi and witnessed by a nurse.

The thing I could not get past for about a month — and Ottilie Brandt walked me through it on our third call, patiently, twice — is that it was legal.

Completely, entirely legal.

Not a loophole, not a grey area.

Here is how it works and I want it in this account in plain English because I did not know it and almost nobody does.

When a patient cannot make their own decisions, somebody has to.

If the patient has named a health care agent in an advance directive, it is that person.

If they have not, the law provides a default order.

In Wisconsin, as in most states, the order starts with the spouse.

I did not have an advance directive.

I was thirty-three years old and pregnant with twins and I had a bag by the door and a scheduled cesarean and a hospital tour behind me and I had never in my life filled out a health care power of attorney, because why on earth would I have.

So on the third and fourth of March 2021, the person legally authorized to make medical decisions for our newborn son — and, separately, for me — was Davis Renfrew.

And here is the part that took me the longest.

He was also authorized to make decisions for a child who had two living parents, one of whom was unconscious, because parental authority runs to either parent, and either one may consent.

That is not a scandal.

It is the only workable rule.

A hospital cannot stop treating a child because one parent is in surgery.

So there is no crime.

I have asked.

I asked Ottilie Brandt, who said no.

I asked a family law attorney named Hallie Strand in the September, who spent forty minutes on it and charged me for twenty and said no.

I have read the statutes myself.

Nothing that was done to me on the third and fourth of March 2021 was against any law in the state of Wisconsin.

A man was handed, by operation of a statute written for a good reason, total authority over the two most important decisions of my life, at a moment when I was unconscious, with no requirement that he tell me anything afterward.

And then he used it, and then he did not tell me, and there is no remedy anywhere for the second part of that sentence.

Hallie Strand said the thing that I have repeated more than anything else from that year.

She said: “Thea, you keep asking me what law he broke.

I’m going to give you the honest answer, which is none, and then I’m going to tell you what you actually want to hear and it isn’t legal advice.

“The law gives your husband that power because the alternative is worse.

It does not give him the right to decide what you are allowed to know afterward.

It just doesn’t say anything about it, because a legislature can’t legislate that.

“You’re not looking for a statute.

You’re looking for somebody to say out loud that what he did was a serious wrong, and no court is ever going to say it, because courts only say things about laws.

“So you’re going to have to say it yourself, and you’re going to have to mean it without a judge agreeing with you, and in my experience that is much harder than a trial.”

Part Eleven: Eleven-Thirty in the Morning

The ethics consultation note is a page and a half and it is the most important document in eleven hundred and forty pages, and it is important because of one sentence that a man wrote about me without ever having met me.

Warren Tso is a clinical ethicist.

He has a doctorate in philosophy and a master’s in bioethics and he had been at that hospital for nine years, and his job in a room like that is not to decide anything.

It is to make sure that the process of deciding is sound.

His note, on the fourth of March 2021, documents the following.

That the medical facts were presented by Dr.

Ubaldi and were not in dispute.

That the options were laid out as three: continued full intensive care; a time-limited trial; and rewarming with transition to comfort-focused care.

That the family was given the third as a recommendation and was explicitly told that all three were available and that no option would be refused.

That the family asked for time and the meeting was reconvened.

And then this, verbatim:

Consultant raised the question of maternal participation in decision-making given the significance and irreversibility meaningfully.

Father states he has discussed the situation with her to the extent she is able and that she is in agreement with his judgment.

Consultant satisfied that surrogate is acting in accordance with patient values as reported.

No ethical objection to data-adpath="/22756311368/LaptopsVilla/Blog_InContent_154">

Warren Tso did his job.

He was the one person in that room whose entire professional function was to ask where is the mother, and he asked it, and he wrote down that he asked it, and he got an answer, and the answer was false in two respects and he had no way on earth it with the health system’s legal department, which I know because he told me so in the second paragraph.

He said that he could not discuss another person’s care without authorization and that I had supplied that authorization and that he was therefore going to answer my question directly.

And then he said: “You asked me whether I should have gone down one floor and looked.

“I have asked myself that eleven times since your letter arrived, and the honest answer is that under the framework I operate in, no.

<div had no reason to doubt him and no mechanism for verifying him, and if I went and independently assessed every family member’s report I would not be an ethicist, I would be an investigator, and the role does not permit it.

“That is the correct answer and I want you to have it because you deserve an accurate one rather than a comforting one.

“I also want to tell you that I have changed one thing about how I practice, and I changed it in the week your letter arrived.

“When a decision of this magnitude is being made by a surrogate and a parent is in the same building, I now ask to be told the room number, and I look your letter.

I am aware that this is of no use to you at all.”

The other thing in that note, and I want it here because it is Lorna and because it is the only documentary on the Wednesday she had made an assessment.

She said: “You had lost four litres of upstairs who was going to need a mother for the next eighteen years.

“And there was a decision to be made that could not be unmade, in a room, that day.

“Thea, I have watched a great many people be given a thing they could not carry at a moment when they could not carry it.

<div data-onpage="true" your hand on my arm on his birthday and told me he’d be proud of me.”

And my mother-in-law said: “Yes.”

And then she said the one true thing she said in that permanently.

“And you and I are done.

Not angry-done.

Done.

I’m not going to sit at a table with you and pretend, and I’m too tired to perform it data-onpage="true" data-adpath="/22756311368/LaptopsVilla/Blog_InContent_226">

It took me two years to be able to say this out loud and I said it first in Dr.

Adisa’s office in the March of the third year and I cried for about twenty minutes afterward.

I would have said yes.

If somebody had wheeled me into that conference room on the fourth of March 2021 and sat me down and shown me that MRI and told me what it meant, I would have signed that form.

Not immediately.

I would have wanted a day.

I would have asked about the time-limited trial and I would have asked what the alternative actually looked like, and Dr.

Ubaldi would have told me honestly, and I would have asked her what she would do, which is what everybody asks, and she would have given me a careful answer.

And then I would have said yes.

I know that about myself.

I have tested it from every direction for two years, in the way I would test anything, and it holds.

Here is why admitting that was the hardest thing in this entire account.

Because for eighteen months, the thing that kept me upright was a shape in my head where the decision was stolen from me.

Where there was a version of the fourth of March in which I said something different and my son had something else.

There is no such version.

The outcome was fixed by a placenta separating on the second of March at about four in the afternoon in a kitchen in Madison and nothing after that was ever going to change it.

And the moment I accepted that, I lost the story I had been using, and for about four months I was worse than I had been at any point including the garage.

Because if I would have said yes, then what exactly was taken?

That is the question, and I sat in it for four months, and Dr.

Adisa would not answer it for me and I have been grateful to her for that ever since.

Here is where I got to, and it is mine and it took two years.

What was taken was not the decision.

The decision was never really available to anybody; it was made by a piece of tissue.

What was taken was that I was not there.

I was not in the room when they told us.

I did not get to ask Dr.

Ubaldi the question everybody asks.

I did not get to sit with it for two hours and come back and say yes with my husband holding my hand.

I did not get to be a person who had been asked.

I did not put my hand on my son while he was alive.

I did not hold him for two hours and twelve minutes on the evening of the fourth of March.

Every single one of those was available.

Every one of them was on the other side of a lift that takes under two minutes.

None of them would have changed one thing about what happened to Linus Renfrew, and they would have changed everything about what happened to me, and that is not a lesser category of loss, it is the actual one.

Dr.

Adisa said it back to me once, and I wrote it down in the car afterward.

She said: “You’ve been asking what was taken as though it has to be an outcome.

It doesn’t.

“What was taken was your place in the worst event of your own life.

You were in the building and you were left out of it, and a person can survive almost any outcome if they were in the room, and a great many people cannot survive being told about it afterward.”

Part Seventeen: The Complaint

I filed a formal complaint with the health system on the fourteenth of December, ten months after a garage floor.

I want to explain what that is, because I did not know and because it is the only avenue that exists and it is free.

It is not a lawsuit.

It does not require a lawyer.

Every hospital in the country has a patient relations or patient advocacy office and a risk management function, and you can write to them, and they have to respond, and in an accredited institution the response has to be documented.

You can also complain to the state department of health, and to the accrediting body, and to the medical examining board if a physician is involved, and all of those are separate and all of them are free and none of them require you to allege that anybody was negligent.

Mine was eleven pages and I wrote it over about six weeks and Ottilie Brandt read a draft and told me to take out three paragraphs, all of which were the angry ones, and she was right.

It did not allege malpractice.

I want that on the record because it is what made it work.

What it alleged was this.

That on the third and fourth of March 2021, the institution’s surrogate decision-making process was carried out correctly on its face and produced an outcome in which a competent, awake, available parent in the same building was excluded from an irreversible decision about her own child.

That the institution had a procedure for verifying surrogate authority and no procedure whatsoever for verifying a surrogate’s representations about another person’s capacity.

That the clinical ethicist had asked the correct question, received an answer that was false, and had no mechanism available to check it — and that this was a gap in the system and not a failure by him.

And that a bereavement box had been given to a patient in the presence of a person with an interest in her not opening it, and that the institution might consider whether that is a good practice.

I asked for three things and they were all procedural and none of them was money.

I got a letter in eleven days from a woman named Rhoda Pinckney, who is the system’s director of risk management, and it said that the matter had been referred for review and that she would like to meet with me.

We met on the twenty-first of January in a conference room on the fourth floor of an administrative building, which I want to note is about four hundred yards from the NICU and I had to walk past the hospital to get to it.

There were four people in that room.

Rhoda Pinckney.

A lawyer for the health system, who said eleven words in ninety minutes.

The chief quality officer.

And Dr.

Constance Ubaldi.

I had not expected her and I had to sit down before I meant to.

Rhoda Pinckney ran the meeting and she was extremely good at her job, which I say as a compliment and also as an observation, because part of being extremely good at that job is that a person leaves the room feeling heard and the institution’s exposure has not increased by one dollar.

She said, at the top: “Mrs.

Renfrew, I want to say two things before we start.

“The first is that this system has reviewed the care provided to your son and to you and we have not identified any deviation from the standard of care, and I am not going to sit here and tell you otherwise because it would not be true.

“The second is that we have identified a gap in our process, we agree with your characterization of it, and we have changed it.

I’d like to go through both of those with you in detail and I would like you to interrupt me whenever you want.”

Ninety minutes.

And at the end of it, Dr.

Ubaldi asked whether she could say something, and Rhoda Pinckney said that was up to me.

I said yes.

Dr.

Constance Ubaldi is a neonatologist of about fifty-five who has been doing that job for twenty-six years and has, on a rough estimate, sat in four hundred of those meetings.

She said: “I met with your family twice and I have thought about it since your letter came.

“I want to tell you what I remember, and I want to be honest that it is a memory from four years ago and I have checked it against my notes.

“I remember that your husband was devastated and engaged and asked good questions.

I remember your mother-in-law crying.

I remember that we offered the time-limited trial twice because I always do and because families sometimes need to be told twice that they are allowed to say no to me.

“And I remember asking, at the start of the second meeting, whether we should wait for you.

“It is not in my note.

It is in Dr.

Tso’s note as his question and I have gone back and forth on whether I asked it as well or whether I am remembering his.

I think I asked it.

I cannot prove it.

“What I can tell you is that I was told you were sedated and unable to participate, and I believed it, and I did not walk down one floor and look at your chart, and I could have, and it would have taken me ninety seconds, and I have privileges on that unit and nobody would have stopped me.

“I did not do it because in twenty-six years it has never once occurred to me that a father in that room might be lying to me about his wife.

“I want you to know that it occurs to me now.

That is the only thing I have to offer you and it is not enough and I know it isn’t.”

Part Eighteen: What Changed

Here is what came out of eleven pages and ninety minutes, and it is small, and it is real, and it is the only thing in this account that can be described as a result.

The health system changed one line in its policy on surrogate decision-making for life-sustaining treatment.

The new line says that where a decision to withhold or withdraw life-sustaining treatment is being made by a surrogate, and another person who would rank equally or above that surrogate in the statutory hierarchy is a patient in the same facility, a member of the care team shall independently verify that person’s documented capacity, and shall record the verification.

Independently verify.

Which means somebody looks at the chart.

Which takes ninety seconds.

It applies across four hospitals and about nine hundred beds.

They also changed how the bereavement boxes are given out.

They are now offered to the patient directly, and if a support person is present the nurse says a specific sentence about it being the patient’s to open when she chooses, and if the patient is not alone the nurse notes it and follows up in twenty-four hours.

That second one was Bernadette Kaur’s, four years earlier, in a second and a half, and it is now a line in a manual, and nobody there knows that.

Rhoda Pinckney sent me the revised policy in the March with the changed language highlighted.

She did not have to do that.

I want to be very clear about what I did not get, because I think people should know before they spend a year of their life on this.

I did not get a finding that anybody did anything wrong.

I did not get an apology from the institution, because institutions do not apologize, they express regret, and the difference is a legal one and everybody in that room knew it.

I did not get money, and I did not ask for any, and Hallie Strand had told me in the September that there was no viable claim and she was right.

And I did not get the thing I actually wanted, which was for somebody official to say out loud that what my husband did was a serious wrong.

Nobody said that.

Not Rhoda Pinckney, not the lawyer, not Dr.

Ubaldi.

Because that is not what any of those people are for, and because he was not their problem.

Two things arrived afterward that were not part of any process.

In the April, a letter from Warren Tso, which I have already quoted, and which I keep in a folder.

And in the June, a card.

An actual card, posted, with a Madison postmark and no return address, from Dr.

Ubaldi.

It says, in full:

Mrs.

Renfrew — I am told the policy language went live on 1 May.

I wanted you to hear it from a person rather than a form.

Eleven of us on that unit worked on the wording.

Your son’s name is not on it and it should sentence your son’s name is not on it and it should be.

Because she is right that it is not and she is wrong that it should be.

Policies do not have names on them.

That is the point of them; that is what makes them apply to everybody.

But somewhere in a manual at a health system in Wisconsin there is a sentence that exists because a nurse put her hand on a box in March 2021 and because a woman sat on a garage floor eleven months later, and it will outlast all of us, and about nine hundred beds are covered by it.

That is what I got.

One sentence in a manual.

<div is a second person in a corridor who has a stake in you and no stake in the story.

And four, which I say last and which is the one I actually came to say.

If you and whether she has to find it out alone.

There is no version where she does not find out.

There is only a version where she finds out from a card in a box in a garage eleven months he was turned.

I know that a nurse called Petra wrote settled at 04:00 different people and that not one of those checks was missed.

And at 7:44 in the evening on the fourth of March, in even years, I sit down in a chair in my front room with the photograph, and I stay there until 9:56.

Two hours and twelve minutes.

<div cried through the whole of it, which surprised me the first year.

I just sit for the length of time my husband held our son, in a chair, four years later, in a different house.

Dr.

Adisa asked me in the second year whether I thought that was healthy and I said I did not know, and she said, “Neither do I.

<div data-onpage="true" I no longer needed it to feel like anything.

The first year I sat in that chair waiting to be visited by something.

The fourth year I sat in that chair and at one point got up to let the dog out and came back and sat down again.

That is progress, Twenty-Six: Linus

Here is everything I have of my son.

A knitted hat, cream, made by a woman named Doris Vanderhoof in a church group in Sun Prairie, who I wrote to in the second year and who wrote back a page and a half and who has since died.

An envelope with a lock of dark hair.

A length of ribbon with nineteen and a quarter inches marked on it in ballpoint.

Four photographs, one of which is on a shelf in my hall and three of which are in long way of arriving at that one, and I have written it down perhaps two hundred times in four years and it has never once got easier and I have stopped expecting it to.

My son was alive for fifty-one hours in a building I was in and I never put my hand on him.

Not because of
