Part One: The Doorway<\/strong><\/p>\n

My sister said eleven words in my doorway on a Saturday morning in October and I have typed them out perhaps two hundred times since, because typing out what people said is what I do for a living.<\/p>\n

“If she gets too upset, you decide.<\/p>\n

You’ve always been the decider.”<\/p>\n

She was standing on my front step in Berwyn at nine forty-one in the morning with a diaper bag over one shoulder and her car keys already in her hand, and she put my niece into my arms and said that, and then she said something about being back by two and got into a car.<\/p>\n

<\/div>\n

I took it as a compliment.<\/p>\n

I want that established at the very front, because everything I did wrong over the following eighteen months came out of the fact that at nine forty-one on the eleventh of October I heard a compliment.<\/p>\n

My name is Alma Restrepo.<\/p>\n

I am a certified shorthand reporter and I have been one for sixteen years.<\/p>\n

<\/div>\n

I sit in depositions and hearings and I make a verbatim record of what is said.<\/p>\n

That is the entire job and it sounds simple and it is not, and the reason it is not is that people do not speak in sentences.<\/p>\n

They stop and restart and talk over each other and say\u00a0um<\/em>\u00a0four hundred times an hour, and my job is to put down exactly what came out of their mouths and nothing else.<\/p>\n

Not what they meant.<\/p>\n

<\/div>\n

Not what they were getting at.<\/p>\n

What they said.<\/p>\n

I am good at it.<\/p>\n

I have been called in on four appellate transcript disputes.<\/p>\n

<\/div>\n

I am the person a firm asks for when the case is going to matter.<\/p>\n

<\/p>\n

And I am going to spend twenty-nine parts explaining how a woman whose entire profession is the difference between what people said and what people meant spent eighteen months getting that distinction exactly backwards about her own family.<\/p>\n

<\/div>\n

My sister is Perla Restrepo.<\/p>\n

She was thirty-three that October.<\/p>\n

Her husband is Curtis Bellew, who was thirty-six and who I had known for nine years and liked.<\/p>\n

Their daughter Esme was six months and eleven days old.<\/p>\n

<\/div>\n

They live in Wheaton, which is forty-one minutes from my house in Berwyn, and they were going to a shopping center about twenty minutes from their own house, which means that on the morning of the eleventh of October my sister drove forty-one minutes east to hand me a baby and then drove back west past her own subdivision to go to a mall.<\/p>\n

I did not think about that for four days.<\/p>\n

Here is what I noticed at the door and what I did not, and I have separated those two things with a great deal of help.<\/p>\n

What I noticed at the door.<\/strong>\u00a0That Perla was in a hurry.<\/p>\n

<\/div>\n

That she was wearing a coat indoors, which she does when she wants a conversation to be short.<\/p>\n

That Esme was in a fleece sleeper and not a coat, on a morning when it was fifty-one degrees.<\/p>\n

That my sister did not come inside, which she always does, because I have a coffee machine she likes.<\/p>\n

What I did not notice at the door.<\/strong>\u00a0Anything at all about the baby.<\/p>\n

<\/div>\n

I want that on the record early because for about four months I believed something else, and I said something else, out loud, to a state investigator and to a police detective, and it turned out not to be true.<\/p>\n

<\/p>\n

She handed me a six-month-old and I looked at my sister’s face and not at the child’s, which is what people do, and I said something about the mall and she said something about needing three hours, and she said the eleven words, and she left.<\/p>\n

<\/div>\n

Twenty minutes later Esme started screaming.<\/p>\n

Part Two: Twenty Minutes<\/strong><\/p>\n

I am going to write this part once and briefly and then not come back to it, because it belongs to a person who is four now and who did not choose to be in an account of anything.<\/p>\n

At about ten o’clock she began to cry and it did not stop and it was not a cry I had heard from her before.<\/p>\n

I did the things.<\/p>\n

<\/p>\n

A bottle.<\/p>\n

<\/div>\n

Upright on my shoulder.<\/p>\n

Walking.<\/p>\n

The dryer, which somebody had told me about.<\/p>\n

Eleven minutes of the four things that work on babies, none of which worked.<\/p>\n

And when I moved her from one arm to the other, shifting her lower, she made a sound that I have never been able to describe to anybody and that I am not going to attempt here.<\/p>\n

<\/div>\n

I put her down on a changing pad on the floor and opened the sleeper.<\/p>\n

<\/p>\n

Her right leg was moving.<\/p>\n

<\/div>\n

Her left leg was not moving at all, and the two did not look the same, and there was a discoloration high on the left thigh at the edge of the diaper, and there was swelling.<\/p>\n

That is the whole of the description and it is all anybody needs.<\/p>\n

What I did next took me about four minutes and I have gone over it with three professionals and I did most of it right.<\/p>\n

I did not call my sister.<\/p>\n

<\/p>\n

I want to explain that, because it became the central fact of the next eighteen months and because my reason at the time was not the reason I later claimed.<\/p>\n

<\/div>\n

The reason I later claimed \u2014 to a detective, to my parents, to myself, for about four months \u2014 was that I knew Perla would tell me to wait.<\/p>\n

The actual reason, which I have since recovered and which is less flattering and much more ordinary, is that I did not think of it.<\/p>\n

I had a screaming infant with a leg that was not moving, and something in me went into a mode I recognize from work, which is the mode where the only thing that exists is the next required action.<\/p>\n

<\/div>\n

I did not deliberate and I did not weigh anything and I did not have a thought about my sister at all.<\/p>\n

<\/p>\n

I put Esme in the car seat and I supported the left leg with my hand while I did the straps, and I drove twenty-eight minutes to the children’s hospital, and I did not speed, which two separate people have since told me is unusual and which I think is just how I am.<\/p>\n

<\/div>\n

And in the parking structure, before I got her out of the car, I did the thing that turned out to matter more than anything else I did that year.<\/p>\n

I opened the notes app on my phone and I typed for ninety seconds.<\/p>\n

I did it because it is a reflex.<\/p>\n

I have spent sixteen years being the person in a room whose job is to preserve what happened, and when something happens to me my hands go to a keyboard the way other people’s hands go to their mouths.<\/p>\n

Here is what I typed, verbatim, and I have never edited it and it has been entered as an exhibit twice.<\/p>\n

<\/p>\n

Sat 11 Oct.<\/em><\/p>\n

<\/div>\n

P dropped E at 9:41.<\/p>\n

P left ~9:43.<\/p>\n

E fine on arrival as far as I saw, did not really look at her.<\/p>\n

Started crying ~10:00-10:05, would not stop.<\/p>\n

Not hunger, not tired.<\/p>\n

Screamed when I shifted her lower on my arm ~10:20.<\/p>\n

<\/div>\n

Opened sleeper ~10:22.<\/p>\n

<\/p>\n

L leg not moving, R moving normally.<\/p>\n

<\/div>\n

Discolouration high L thigh under diaper edge, swelling, legs not same size.<\/p>\n

Left house ~10:31.<\/p>\n

Arrived hospital 10:59.<\/p>\n

Did not call P.<\/p>\n

One hundred and nine words.<\/p>\n

E fine on arrival as far as I saw, did not really look at her.<\/em><\/p>\n

<\/div>\n

I typed that, in a parking structure, on the eleventh of October, before anybody had asked me a single question and before I had any idea that a question would ever be asked.<\/p>\n

<\/p>\n

And four months later I sat in a room and told a police detective, with complete conviction, that my niece had been whimpering in my sister’s arms at the door.<\/p>\n

<\/div>\n

Part Three: The First Three Hours<\/strong><\/p>\n

You do not walk into a pediatric emergency department and get triaged and seen.<\/p>\n

You get taken straight back, and that is how you know it is bad.<\/p>\n

I said, at the desk, “Six-month-old, left leg isn’t moving, there’s swelling and a mark on the thigh, she’s been screaming for an hour,” and a woman came round the counter before I finished the sentence.<\/p>\n

<\/div>\n

The attending was a man named Prosper Adeyemi and he was, I would guess, about forty.<\/p>\n

<\/p>\n

He was extremely calm and he did not tell me anything was going to be fine, which I noticed at the time and appreciated later.<\/p>\n

<\/div>\n

They took an X-ray within about twenty minutes.<\/p>\n

And then \u2014 and this is the part that nobody who has not been through it understands \u2014 the questions started, and they did not stop for three hours, and the same questions came from four different people.<\/p>\n

What time did she arrive at your house.<\/p>\n

Who brought her.<\/p>\n

Was anybody else present.<\/p>\n

Did she fall.<\/p>\n

<\/div>\n

Did you drop her.<\/p>\n

<\/p>\n

Did she roll off anything.<\/p>\n

<\/div>\n

Did you trip while carrying her.<\/p>\n

Did anything happen in the car.<\/p>\n

Has this happened before.<\/p>\n

What time did she start crying.<\/p>\n

What time did you look at the leg.<\/p>\n

What time did you leave.<\/p>\n

<\/div>\n

What time did you arrive.<\/p>\n

<\/p>\n

I answered all of them and I had the note on my phone and I read from it, and I want to say that the fact that I had a note was the most fortunate thing that has ever happened to me and also that it made me look, for about four days, considerably stranger than an innocent person is supposed to look.<\/p>\n

<\/div>\n

A woman asked me, at one point, in a perfectly pleasant voice: “You made notes in the car park?”<\/p>\n

And I said, “I’m a court reporter.”<\/p>\n

And she said, “Okay,” and wrote it down.<\/p>\n

I have since been told by my own attorney \u2014 I will get to why I had one \u2014 that the note is the single reason the first seventy-two hours went the way they did rather than a considerably worse way.<\/p>\n

<\/div>\n

A contemporaneous record made before anybody knew there was anything to record is, in her words, “the closest thing to a time machine that exists in this business.”<\/p>\n

<\/p>\n

Dr.<\/p>\n

<\/div>\n

Adeyemi came back at about one o’clock and pulled the curtain and sat down, which is the thing they do when they are about to say something.<\/p>\n

He said: “Esme has a fracture of the left femur.<\/p>\n

It’s a transverse fracture of the shaft.<\/p>\n

It’s recent and it’s acute.”<\/p>\n

I said something like: how.<\/p>\n

And he said the thing that I have repeated to about nine people since, and I am giving it as close to verbatim as I can.<\/p>\n

<\/div>\n

“I want to explain what happens next, and I want to explain it before you ask, because otherwise it will feel like something is being done to you.<\/p>\n

<\/p>\n

“This child is six months old and she is not walking, not crawling, and not pulling to stand.<\/p>\n

<\/div>\n

A femur is the largest bone in the body.<\/p>\n

In a child who is not independently mobile, a femur fracture without a clear and verifiable accidental mechanism is not something we can attribute to ordinary life.<\/p>\n

“That means I am required by law to make a report, and I have already made it, and I made it before I came in here.<\/p>\n

<\/div>\n

“I am not accusing you of anything.<\/p>\n

<\/p>\n

I do not know what happened and it is not my job to know.<\/p>\n

<\/div>\n

My job is to treat her, to document exactly what I find, and to notify the people whose job it is to find out.<\/p>\n

“There will be a skeletal survey.<\/p>\n

That is a series of about twenty X-rays of her whole body and it is standard and it is not optional.<\/p>\n

There will be a consult with a child abuse pediatrician.<\/p>\n

<\/div>\n

The Department of Children and Family Services has been notified and somebody will come, probably today.<\/p>\n

<\/p>\n

The police may also come.<\/p>\n

<\/div>\n

“Everyone who had care of her in the relevant period is going to be interviewed separately, including you.<\/p>\n

That is not because anyone suspects you.<\/p>\n

It is because that is what a competent investigation looks like, and if they did it any other way it would not be worth anything.”<\/p>\n

Then he said: “Do you want to call her parents or would you like me to?”<\/p>\n

<\/div>\n

And I said I would do it.<\/p>\n

<\/p>\n

I called my sister at 1:14 in the afternoon from a corridor.<\/p>\n

<\/div>\n

She answered on the fourth ring and there was noise behind her, and I said, “Perla, I’m at Children’s with Esme, her leg is broken.”<\/p>\n

And my sister said: “What?”<\/p>\n

And then, before I said anything else, she said: “Was she okay when I left her?”<\/p>\n

I have typed that out more times than the eleven words in the doorway.<\/p>\n

<\/div>\n

It was the second sentence out of her mouth.<\/p>\n

<\/p>\n

Not\u00a0is she all right.<\/em>\u00a0Not\u00a0which leg.<\/em>\u00a0Not\u00a0what happened.<\/em><\/p>\n

<\/div>\n

Was she okay when I left her.<\/em><\/p>\n

And for four months I believed that sentence was the thread that unravelled everything, and I pulled it as hard as I could, and I was wrong about what it meant.<\/p>\n

Part Four: Two Forty in the Afternoon<\/strong><\/p>\n

They arrived at two forty, an hour and twenty-six minutes after I called.<\/p>\n

The drive from that shopping centre to that hospital is fifty-one minutes with no traffic.<\/p>\n

<\/div>\n

I have driven it.<\/p>\n

<\/p>\n

There is a gap of about thirty-five minutes in there that I spent four months turning into a conspiracy and that turned out to be a queue at a parking structure and a wrong exit.<\/p>\n

<\/div>\n

Perla came in first.<\/p>\n

I have never seen a person’s face do what hers did when Dr.<\/p>\n

Adeyemi said the word femur.<\/p>\n

She went grey and put her hand on the bed rail and a nurse got a chair behind her in about two seconds, which told me that nurse had done it before.<\/p>\n

Curtis came in behind her and stood.<\/p>\n

<\/div>\n

And within about ninety seconds, my brother-in-law asked the question that I put in front of a detective four days later and that I would put in front of one again tomorrow.<\/p>\n

<\/p>\n

He said: “Can the X-ray tell you when it happened?<\/p>\n

<\/div>\n

Like, what time?”<\/p>\n

Dr.<\/p>\n

Adeyemi said: “We can say it’s acute and recent.<\/p>\n

We cannot put a clock time on it from a single film.”<\/p>\n

And Curtis Bellew nodded, slowly, twice.<\/p>\n

I want to be careful here, because this is the exact place where I began to go wrong, and I went wrong by being right.<\/p>\n

<\/div>\n

That question was, in fact, significant.<\/p>\n

<\/p>\n

Detective Bonaventura told me so, months later, in about those words:\u00a0it’s the first thing he asked and it’s about time and not about her, and yeah, we noticed.<\/em><\/p>\n

<\/div>\n

So I was right about the question.<\/p>\n

And from that single nod I built, over sixteen weeks, an entire architecture, and the architecture was wrong, and the fact that its foundation stone was genuine is exactly what made it impossible for me to see.<\/p>\n

Then my sister said the sentence.<\/p>\n

She did not say it to me.<\/p>\n

She said it to Dr.<\/p>\n

<\/div>\n

Adeyemi, looking at him, from a chair, with both hands flat on her knees.<\/p>\n

<\/p>\n

“When we left her with Alma, she was perfectly fine.”<\/p>\n

<\/div>\n

And I said \u2014 and I am not going to dress this up, because there were four medical professionals in that bay and it is in three separate sets of notes \u2014 “She was not fine.<\/p>\n

She was already hurting when you handed her to me.”<\/p>\n

I said that at two forty-four in the afternoon on the eleventh of October.<\/p>\n

Ninety minutes after I typed, in a parking structure,\u00a0E fine on arrival as far as I saw, did not really look at her.<\/em><\/p>\n

<\/div>\n

I did not know I had done that.<\/p>\n

<\/p>\n

I want to be very clear, because the worst possible reading of me is that I knew and said it anyway, and that is not what happened and it has been established that it is not what happened, because the note was on my phone and the metadata is what it is.<\/p>\n

<\/div>\n

What happened is that at two forty-four in the afternoon my sister said a sentence that put me inside a window, and something in me answered before I had consulted anything, and what came out was not a lie and it was not the truth.<\/p>\n

It was the shape of what I needed to be true, produced at speed, under threat.<\/p>\n

<\/div>\n

Ninety minutes.<\/p>\n

<\/p>\n

That is how long it took.<\/p>\n

<\/div>\n

I have spent sixteen years listening to witnesses do exactly that in depositions, and thinking, privately, behind a machine,\u00a0that is not what you said on page forty-one.<\/em><\/p>\n

Nobody corrected me in that bay.<\/p>\n

Dr.<\/p>\n

Adeyemi wrote it down.<\/p>\n

A nurse wrote it down.<\/p>\n

And Perla looked at the floor and did not answer, which at the time I read as guilt and which I now believe was something else entirely, and I will get to it in Part Twenty.<\/p>\n

<\/div>\n

Part Five: The Whisper<\/strong><\/p>\n

<\/p>\n

At about four o’clock, a social worker from the hospital and a woman from the Department of Children and Family Services arrived, and it was explained that everybody would be spoken to separately.<\/p>\n

<\/div>\n

And as I stood up, my sister leaned in, close to my ear, and said seven words.<\/p>\n

“Just tell them you found it after.”<\/p>\n

I did not answer her.<\/p>\n

I walked out of the bay and down a corridor and into a small room with a table in it.<\/p>\n

I did not report that sentence for three days.<\/p>\n

That is a fact about me that I have had to look at for a long time and I am going to put it down honestly, because it is the only part of the first week where I behaved like a sister rather than like a stenographer.<\/p>\n

<\/div>\n

I sat in that room for fifty minutes and answered every question and I read out my note and I did not mention what she had said in my ear, and when I drove home at eight o’clock that night I told my husband about it and then I did not do anything about it for three days.<\/p>\n

<\/p>\n

Hugo \u2014 my husband, Hugo Barranco, who I have been married to for eleven years and who is the most patient man alive \u2014 said, on the second night: “Alma.<\/p>\n

<\/div>\n

You have to tell them.”<\/p>\n

And I said, “I know.”<\/p>\n

And he said, “When?”<\/p>\n

And I said, “I don’t know.”<\/p>\n

Here is what I was actually doing in those three days, and I did not understand it at the time.<\/p>\n

I was trying to find a version of that sentence that was innocent.<\/p>\n

<\/div>\n

And there is one, incidentally.<\/p>\n

<\/p>\n

It took me two years to find it, and it is this: a terrified woman, who has just heard a word she did not expect, who has already said one thing out loud to a doctor, leans over and asks her sister to say the same thing, not because she is constructing a defence but because she cannot survive the two of us contradicting each other in front of strangers.<\/p>\n

<\/div>\n

That is a real reading.<\/p>\n

I do not think it is the true one.<\/p>\n

I think there was something more self-protective in it than that, and my sister has told me since that she does not fully know what she meant either, which I believe.<\/p>\n

But it is a real reading, and I could not see it, because I was inside the window and a person inside the window cannot do subtlety.<\/p>\n

<\/div>\n

What finally moved me was not conscience.<\/p>\n

<\/p>\n

It was the third night, when Hugo said something that I have quoted since.<\/p>\n

<\/div>\n

He said: “You’re not deciding whether to tell them.<\/p>\n

You’re deciding whether they hear it from you or from her.”<\/p>\n

I reported it on the fourteenth, to Dovie Mwangi at DCFS, in a follow-up interview, and I reported it flatly, and I said I was reporting it three days late and I said why.<\/p>\n

She wrote it down and asked me two questions about the wording and then she said something I was not expecting.<\/p>\n

<\/div>\n

She said: “Ms.<\/p>\n

<\/p>\n

Restrepo, thank you for telling me it took you three days.<\/p>\n

<\/div>\n

Most people give me the sentence and not the three days, and the three days is usually the more useful thing.”<\/p>\n

Part Six: Inside the Window<\/strong><\/p>\n

I need to describe what it is like to be a person who has done nothing and who is inside the window, because I did not know and because I have since found out that almost nobody knows.<\/p>\n

<\/div>\n

The window, in our case, was from nine forty-three in the morning, when my sister’s car left my driveway, until ten fifty-nine, when I walked into an emergency department.<\/p>\n

<\/p>\n

One hour and sixteen minutes.<\/p>\n

<\/div>\n

For that hour and sixteen minutes there was exactly one adult with Esme Bellew and it was me, and there is no camera anywhere in my house and my husband was at his brother’s until two and no neighbour saw anything.<\/p>\n

Nobody ever said I was a suspect.<\/p>\n

Not one person, in eighteen months, used that word to me.<\/p>\n

Dr.<\/p>\n

<\/div>\n

Adeyemi did not.<\/p>\n

<\/p>\n

Dovie Mwangi did not.<\/p>\n

<\/div>\n

Detective Bonaventura went out of his way not to.<\/p>\n

And every single thing that happened from the eleventh of October onwards happened to a woman who could not be excluded.<\/p>\n

Here is what that actually consists of.<\/p>\n

You are interviewed separately.<\/p>\n

Not once \u2014 four times in the first three weeks, by three different agencies, and each time you tell the same story and each time you are aware that they are checking it against the last one.<\/p>\n

<\/div>\n

You are asked, in the second interview, about things you did not mention in the first.<\/p>\n

<\/p>\n

Not accusingly.<\/p>\n

<\/div>\n

It is worse than accusingly; it is neutrally.<\/p>\n

You are asked whether you have ever had any involvement with child protective services in any state.<\/p>\n

You are asked whether you have children of your own.<\/p>\n

I do not.<\/p>\n

I am thirty-eight and I do not, and there is a reason and it is mine and it took two rounds of a thing I am not going to write about, and I was asked about it, in a small room, twice, by two different people, and both times I answered and both times I sat in my car afterward for a while.<\/p>\n

<\/div>\n

You go home and you look at your own hands.<\/p>\n

<\/p>\n

That is the part nobody tells you.<\/p>\n

<\/div>\n

On the second night I sat on the edge of my bed and I went through the hour and sixteen minutes minute by minute, four times, because a part of my brain had decided that it needed to be absolutely certain that I had not done something.<\/p>\n

I knew I had not.<\/p>\n

I know it now and I knew it then.<\/p>\n

<\/div>\n

And I did it anyway, four times, and then again in the November, and I have described this to a therapist named Imogen Achara who told me it is so common in this situation that it has a shape and a name.<\/p>\n

<\/p>\n

And then \u2014 this is the last piece and it is the one that made me do the thing in Part Thirteen \u2014 you realize that you are being asked to prove a negative, in a case where the only other people who can speak to the timeline have an interest in the answer.<\/p>\n

<\/div>\n

My sister had said, to a doctor, in front of witnesses,\u00a0when we left her with Alma, she was perfectly fine.<\/em><\/p>\n

If that sentence were true, there is only one place the injury could have happened.<\/p>\n

I want to say clearly that I do not believe my sister said it in order to do that.<\/p>\n

I did believe it for four months.<\/p>\n

<\/div>\n

I do not now.<\/p>\n

<\/p>\n

But intention is not the point and it never was.<\/p>\n

<\/div>\n

It did not matter one bit what Perla Restrepo meant by that sentence.<\/p>\n

What mattered was that it was on a chart, in a hospital, in the handwriting of an attending physician, and that it pointed at exactly one person, and that the person it pointed at was the one who had driven the child in.<\/p>\n

And the thing about being pointed at is that you do not get to be the same person afterward.<\/p>\n

<\/div>\n

I was, until the eleventh of October 2022, a woman who fundamentally believed that if you tell the truth carefully enough, it works.<\/p>\n

<\/p>\n

That is, I now think, a belief you can only hold if nobody has ever had a reason to say otherwise about you.<\/p>\n

<\/div>\n

Part Seven: Twenty-One Films<\/strong><\/p>\n

A skeletal survey is not one X-ray.<\/p>\n

It is a standardized set \u2014 about twenty-one images in a six-month-old \u2014 covering the skull, the spine, the ribs, the pelvis and every long bone, taken in prescribed views, read by a pediatric radiologist.<\/p>\n

It is mandatory in this country for any child under two with a suspicious injury, and it exists for one reason, which is that an infant who has been hurt once has frequently been hurt before and cannot say so.<\/p>\n

<\/div>\n

Esme’s was done on the afternoon of the eleventh.<\/p>\n

<\/p>\n

And there is a second one, which almost nobody outside of the field knows about, and which I did not know about and which turned out to be the piece that decided everything.<\/p>\n

<\/div>\n

A repeat skeletal survey is performed approximately two weeks later.<\/p>\n

The reason is that certain fractures \u2014 rib fractures in particular, and especially posterior rib fractures \u2014 are extremely difficult to see when they are fresh.<\/p>\n

They become visible later, when the bone starts to heal and lays down new tissue around the break.<\/p>\n

A survey that is clean on day one is not a clean survey.<\/p>\n

<\/div>\n

It is a survey that has not finished yet.<\/p>\n

<\/p>\n

The first survey, on the eleventh of October, showed one thing besides the femur.<\/p>\n

<\/div>\n

A healing fracture of the left seventh rib, posteriorly, with callus formation.<\/p>\n

Callus is the material the body lays down around a break while it is mending, and it is visible on an X-ray, and it appears on a timetable that is reasonably well characterized in the literature.<\/p>\n

The radiologist’s estimate was two to five weeks.<\/p>\n

Two to five weeks before the eleventh of October.<\/p>\n

<\/div>\n

Esme had never been in my care for longer than about ninety minutes at a time in her life, and the last occasion before the eleventh was the fourteenth of August, and that was at my parents’ house with six other people present.<\/p>\n

<\/p>\n

I want to describe what happened in the family lounge when the rib was explained, because it is the only time I have ever watched a room of people receive the same sentence and go four different directions.<\/p>\n

<\/div>\n

Dr.<\/p>\n

Adeyemi was not the one who said it; a resident began to and then a more senior person took over, which I noticed.<\/p>\n

My mother said, “A rib?<\/p>\n

From what?”<\/p>\n

My father did not say anything at all and left the room after about forty seconds and stood in the corridor.<\/p>\n

Curtis said: “She’s been on a swing at daycare.”<\/p>\n

<\/div>\n

Which is a sentence I have thought about several hundred times, because Esme was six months old and had never been to daycare, and because nobody in that room corrected him, and because I am fairly sure now that he did not know he had said it.<\/p>\n

<\/p>\n

And my sister said nothing.<\/p>\n

<\/div>\n

She sat down on a plastic chair and put her hands over her face and stayed like that for a long time, and I have never been able to decide what was in it.<\/p>\n

The repeat survey on the twenty-fifth of October showed two further healing rib fractures \u2014 the left sixth and the left eighth, both posterior \u2014 that had not been visible on the eleventh.<\/p>\n

<\/div>\n

Three ribs.<\/p>\n

<\/p>\n

Left side.<\/p>\n

<\/div>\n

Posterior.<\/p>\n

All of similar age.<\/p>\n

And that is the point at which this stopped being a case about an hour and sixteen minutes.<\/p>\n

Part Eight: Dr. Halima Bright<\/strong><\/p>\n

There is a medical subspecialty called child abuse pediatrics.<\/p>\n

It has been a board-certified subspecialty in the United States since 2009 and there are, at the time of writing, a few hundred people in the country who hold that certification.<\/p>\n

<\/div>\n

I did not know it existed.<\/p>\n

<\/p>\n

Almost nobody does.<\/p>\n

<\/div>\n

Dr.<\/p>\n

Halima Bright is one of them.<\/p>\n

She was fifty-four, she had been a general pediatrician for eleven years before she did the fellowship, and she is the person a hospital calls when an infant arrives with an injury that does not have an explanation.<\/p>\n

I met her once, formally, in a small room on the fourth floor, on the nineteenth of October, at my own request, and she agreed to see me for twenty minutes and gave me forty-one.<\/p>\n

<\/div>\n

I went in there prepared to be treated as a suspect and I was not, and what she actually did was explain her own job, carefully, to a woman who was terrified, and I have never forgotten it.<\/p>\n

<\/p>\n

She said: “I want to tell you what I am and what I am not, because people get this wrong in both directions.<\/p>\n

<\/div>\n

“I am not an investigator.<\/p>\n

I do not determine who did anything.<\/p>\n

I have no idea who hurt this child and it is not my function to find out and I will not be offering an opinion on it to anybody.<\/p>\n

“What I do is narrower and it is the only thing I am qualified to do.<\/p>\n

“I am given a set of injuries and a set of histories \u2014 the accounts the adults have provided \u2014 and I answer one question: is this injury consistent with this history.<\/p>\n

<\/div>\n

That is it.<\/p>\n

<\/p>\n

That is the whole job.<\/p>\n

<\/div>\n

“I will tell you now that the most common thing I do, by a very wide margin, is exclude abuse.<\/p>\n

People imagine this job is about finding it.<\/p>\n

Most weeks it is about finding the metabolic bone disease, or the birth injury, or the genuinely unlucky fall off a couch that everybody is terrified about, and writing it down so that a family can go home.”<\/p>\n

<\/div>\n

Then she said: “I am going to say one more thing and then you can ask me whatever you came to ask.<\/p>\n

<\/p>\n

“The reason this subspecialty exists is that before it existed, this was done badly in both directions.<\/p>\n

<\/div>\n

Children were sent home to be hurt again, and families were destroyed on the basis of findings that turned out to be rickets.<\/p>\n

Both of those happened routinely and both of them are catastrophic and the second one is not less catastrophic than the first.<\/p>\n

“So when I am careful with you, it is not because I am being cagey.<\/p>\n

<\/div>\n

It is because being wrong in this job has two different ways of ruining a life and I have to hold both of them at once, every time.”<\/p>\n

<\/p>\n

I asked her the question I had come to ask, which I had rehearsed in a car park.<\/p>\n

<\/div>\n

I said: “Can you tell whether it happened while she was with me?”<\/p>\n

And Dr.<\/p>\n

Bright said: “I can tell you a range.<\/p>\n

I cannot tell you a clock time and anybody who tells you they can is not being straight with you.<\/p>\n

“What I can do, and what I will be doing, is put the medical findings next to every account that has been given, and identify where they fit and where they do not.”<\/p>\n

<\/div>\n

And then she said: “Ms.<\/p>\n

<\/p>\n

Restrepo.<\/p>\n

<\/div>\n

You have a contemporaneous note with times in it that was made before anybody knew there was a case.<\/p>\n

“In eleven years of doing this I have had that perhaps four times.”<\/p>\n

Part Nine: What Can Actually Be Dated<\/strong><\/p>\n

I am going to set out the medicine plainly, because it is the spine of everything that followed and because I had to learn it and because almost every account of a case like this gets it wrong.<\/p>\n

<\/div>\n

People believe that an X-ray can date a fracture the way a carbon test dates a bone.<\/p>\n

<\/p>\n

It cannot.<\/p>\n

<\/div>\n

What can be dated is healing, and healing happens on a schedule that is reasonably well described, and the schedule is a range and not a point.<\/p>\n

For the femur.<\/strong><\/p>\n

A transverse fracture of the femoral shaft in an infant causes immediate, severe, unmistakable pain.<\/p>\n

It is not an injury a child sleeps through and it is not an injury that announces itself two days later.<\/p>\n

<\/div>\n

A fracture like that produces a scream at the moment it occurs, and then a period of distress, and then a baby who is inconsolable when the limb is moved and relatively settled when it is not.<\/p>\n

<\/p>\n

Soft tissue swelling develops over a period of hours.<\/p>\n

<\/div>\n

Bruising over a femur is, in fact, not especially common and when it appears it tends to appear later rather than immediately, because the bone is deep and surrounded by a great deal of muscle.<\/p>\n

That surprised me and it is the single most counterintuitive fact in this entire account: the mark I found at ten twenty-two in the morning was, if anything, evidence\u00a0against<\/em>\u00a0the injury having happened in the previous forty minutes.<\/p>\n

<\/div>\n

And periosteal reaction \u2014 the first visible healing on a film \u2014 begins to appear at roughly seven to fourteen days, and there was none.<\/p>\n

<\/p>\n

So: acute.<\/p>\n

<\/div>\n

Less than a week.<\/p>\n

Almost certainly less than seventy-two hours.<\/p>\n

And, taken together with the described behaviour, consistent with an event that happened during the night of the tenth into the morning of the eleventh.<\/p>\n

For the ribs.<\/strong><\/p>\n

Three posterior rib fractures, left side, sixth, seventh and eighth, all with callus of similar maturity, estimated at two to five weeks.<\/p>\n

<\/div>\n

And here is the thing about posterior rib fractures in infants that I did not know and that changed how I understood the whole year.<\/p>\n

<\/p>\n

They are not a fall injury.<\/p>\n

<\/div>\n

The mechanism is compression of the chest front to back \u2014 the rib is levered over the transverse process of the vertebra and breaks at the back.<\/p>\n

In an infant, essentially the only thing that produces it is a pair of adult hands around the chest, squeezing.<\/p>\n

Not shaking a rattle.<\/p>\n

Not a car seat.<\/p>\n

Not rolling off a sofa.<\/p>\n

Not, and Dr.<\/p>\n

<\/div>\n

Bright addressed this directly because somebody always raises it, ordinary CPR, which has been studied and which does not produce posterior rib fractures in infants in any meaningful number.<\/p>\n

<\/p>\n

Dr.<\/p>\n

<\/div>\n

Bright’s report ran to nine pages and I have read it about thirty times.<\/p>\n

Its conclusions, in the language she used, were:<\/p>\n

That the femoral fracture was acute and was not consistent with any accidental mechanism described by any caregiver.<\/p>\n

That the reported behavioural change beginning at approximately two o’clock in the morning on the eleventh of October \u2014 an immediate cry during a diaper change, followed by reduced movement of the left leg \u2014 was consistent with the timing of the femoral injury.<\/p>\n

<\/div>\n

That the child’s presentation at 10:59 a.m. was consistent with an injury sustained several hours earlier and not with one sustained in the preceding hour.<\/p>\n

<\/p>\n

And that the three healing posterior rib fractures were not explained by any history provided by any person and were highly specific for inflicted injury.<\/p>\n

<\/div>\n

Nine pages.<\/p>\n

One woman, four days of work, a radiologist, and a set of films.<\/p>\n

That is what cleared me.<\/p>\n

Not my truthfulness.<\/p>\n

Not my note, although the note mattered enormously for a different reason.<\/p>\n

Not anybody believing me because I have an honest face and sixteen years of professional credibility.<\/p>\n

<\/div>\n

A physician looked at a set of images and said that a baby who arrived at eleven in the morning with that degree of swelling had not been broken at ten.<\/p>\n

<\/p>\n

I have thought a great deal about what would have happened to me if Esme had arrived at the hospital ninety minutes earlier, before the swelling had developed.<\/p>\n

<\/div>\n

Dr.<\/p>\n

Bright, when I finally asked her that question \u2014 two years later, at a conference where she was speaking and where I approached her afterward like a lunatic \u2014 said: “Then it would have been harder, and it would have taken longer, and the ribs would still have been there.<\/p>\n

“The ribs were always going to be the case.<\/p>\n

The femur is what got her in the door.”<\/p>\n

<\/div>\n

Part Ten: The Corridor<\/strong><\/p>\n

<\/p>\n

Curtis told me about two o’clock in the morning on the thirteenth of October, standing outside the family lounge on the fourth floor, holding two cups of coffee, one of which was for me.<\/p>\n

<\/div>\n

He did it casually.<\/p>\n

That is the word and I have thought about whether it is fair and it is.<\/p>\n

He said \u2014 and I typed this into my phone four minutes later, in a stairwell, before I did anything else, and this is verbatim from that note:<\/p>\n

“I’ve been thinking about it.<\/em><\/p>\n

It was probably the two a.m. change.<\/p>\n

<\/div>\n

Her leg got caught when I was lifting her hips up and she screamed.<\/p>\n

<\/p>\n

Like really screamed.<\/p>\n

<\/div>\n

But she settled after.”<\/p>\n

I said: “Caught on what?”<\/p>\n

And he said he did not know.<\/p>\n

He said something about the changing pad and something about the strap and then he stopped and started again and said he was exhausted and that he had been up since five the previous day and that he might have been rougher than he meant to be but that he had not pulled it or twisted it.<\/p>\n

<\/div>\n

And I said, “She screamed?”<\/p>\n

<\/p>\n

And Curtis Bellew said, “Yeah.<\/p>\n

<\/div>\n

Right when it happened.<\/p>\n

Really loud, like a proper scream, and then she was okay after about twenty minutes.”<\/p>\n

Here is what I want to say about that conversation, and it took me a long time to be able to separate the two things in it.<\/p>\n

What he actually gave me<\/strong>\u00a0was the single most important piece of evidence in the entire case, and it came out of his own mouth, unprompted, to a witness, on day three, and it has never been retracted by him or by anybody.<\/p>\n

<\/div>\n

An event.<\/p>\n

<\/p>\n

A time.<\/p>\n

<\/div>\n

A mechanism.<\/p>\n

And a scream.<\/p>\n

The scream is the thing.<\/p>\n

Dr.<\/p>\n

Bright’s report turns on it.<\/p>\n

A transverse femoral shaft fracture in an infant produces immediate, unmistakable distress, and Curtis Bellew told me, in a corridor, that at two o’clock in the morning his daughter screamed while he was handling her leg.<\/p>\n

<\/div>\n

Nobody made him say that.<\/p>\n

<\/p>\n

No detective interviewed him into it.<\/p>\n

<\/div>\n

He walked up to me with a cup of coffee.<\/p>\n

And what I did with it<\/strong>\u00a0was decide, within about ninety seconds, that he was testing a story on me.<\/p>\n

I decided that because of my job.<\/p>\n

I have sat behind a machine in four hundred depositions and I know what it looks like when a witness is trying a version out \u2014 the false casualness, the detail that keeps moving, the\u00a0probably<\/em>\u00a0and the\u00a0like<\/em>\u00a0and the\u00a0I’ve been thinking about it.<\/em><\/p>\n

<\/div>\n

And I was, in fact, right about all of that.<\/p>\n

<\/p>\n

He was testing it.<\/p>\n

<\/div>\n

Detective Bonaventura has since told me, more or less, that Curtis Bellew told four different people four slightly different versions of that two o’clock incident in the first week and that the drift between them is in the file.<\/p>\n

But being right about what a man was doing is not the same as being right about what he had done, and I did not hold those apart for four months.<\/p>\n

<\/div>\n

I typed it out and I sent it to Dovie Mwangi that night and I copied Detective Bonaventura in the morning.<\/p>\n

<\/p>\n

And then I started building.<\/p>\n

<\/div>\n

Part Eleven: Why I Hired a Lawyer in Week One<\/strong><\/p>\n

I retained an attorney on the eighteenth of October, seven days in, and it cost me four thousand dollars as a retainer and about nine thousand in the end, and it is the best money I have ever spent and I recommend it without reservation to anybody in this position.<\/p>\n

<\/div>\n

I want to explain this properly because it feels, to an innocent person, like an admission, and it is not, and that instinct is the single most dangerous thing about being inside a window.<\/p>\n

<\/p>\n

Her name is Rosalind Vey.<\/p>\n

<\/div>\n

She does criminal defence and she has an office above a dry cleaner in Oak Park and she is about sixty and she took my call on a Tuesday afternoon and let me talk for eleven minutes without interrupting.<\/p>\n

And then she said: “Okay.<\/p>\n

First thing.<\/p>\n

Have you been interviewed?”<\/p>\n

“Three times.”<\/p>\n

“By whom?”<\/p>\n

<\/div>\n

“Hospital social work, DCFS twice, and a detective once.”<\/p>\n

<\/p>\n

“Did you have counsel present for any of them?”<\/p>\n

<\/div>\n

“No.”<\/p>\n

And Rosalind Vey said, “Right.<\/p>\n

Well, you’ve done the dangerous part already, so let’s talk about the rest of it.”<\/p>\n

She explained four things to me in that first meeting and I am going to put all four here because nobody ever told me and somebody should.<\/p>\n

One.<\/strong>\u00a0A DCFS investigation and a criminal investigation are two different proceedings with two different standards and two different agencies, and the fact that you are cleared in one does not clear you in the other, and information moves between them freely and does not move back.<\/p>\n

<\/div>\n

Two.<\/strong>\u00a0In an Illinois child protection investigation the finding is\u00a0indicated<\/em>\u00a0or\u00a0unfounded<\/em>, and an indicated finding for an adult goes into the State Central Register.<\/p>\n

<\/p>\n

That is a registry.<\/p>\n

<\/div>\n

If you are indicated, that follows you \u2014 it appears on background checks for any job involving children, for foster licensing, for school volunteering, for coaching.<\/p>\n

It is not a criminal conviction.<\/p>\n

It is not public.<\/p>\n

And it can end a career, and people do not know it exists until it is on them.<\/p>\n

She said: “You could be indicated on this.<\/p>\n

<\/div>\n

Not because anybody thinks you did it.<\/p>\n

<\/p>\n

Because you were the caregiver in the window and because ‘inadequate supervision’ is a finding that exists and because investigators are human and overworked.<\/p>\n

<\/div>\n

And if that happens, there is an appeal, and it takes about a year, and you do not want to be starting that conversation without somebody.”<\/p>\n

Three.<\/strong>\u00a0Everything you say is a document.<\/p>\n

Every interview generates a narrative summary written by somebody else in their own words.<\/p>\n

You will not see it.<\/p>\n

It will be compared against every other thing you have said.<\/p>\n

<\/div>\n

And a small inconsistency, entirely innocent, in your fourth account of a bad morning, is the sort of thing that gets highlighted.<\/p>\n

<\/p>\n

“Which is why,” she said, “I want you to stop doing interviews without me, starting today, and I want you to keep doing them\u00a0with<\/em>\u00a0me, because a person who stops cooperating looks exactly like what you do not want to look like.”<\/p>\n

<\/div>\n

And four,<\/strong>\u00a0which is the one I have repeated to other people since.<\/p>\n

She said: “You are going to want to help.<\/p>\n

You are going to want to bring them things.<\/p>\n

You have a job that makes you good at noticing and you are going to start noticing, and you are going to want to hand every single thing you notice to somebody with a badge.<\/p>\n

<\/div>\n

“Bring it to me first.<\/p>\n

<\/p>\n

Every time.<\/p>\n

<\/div>\n

Not because I’ll stop you \u2014 I’ll pass most of it straight on.<\/p>\n

Because you are a witness and you do not know the difference between a fact and a conclusion when it is about your own sister, and nobody does, and that is what I am for.”<\/p>\n

I did not follow that advice.<\/p>\n

Three times I did.<\/p>\n

On the fourth occasion, in the February, I did not, and it is the single worst thing I did in eighteen months, and it is Part Sixteen.<\/p>\n

<\/div>\n

Part Twelve: The Theory<\/strong><\/p>\n

<\/p>\n

I built it between the fourteenth of October and the end of January and it was beautiful and I believed every word of it and I was wrong.<\/p>\n

<\/div>\n

I am going to lay it out the way I laid it out then, in order, because the only way to explain how a reasonable person gets there is to show the construction.<\/p>\n

One.<\/strong>\u00a0On the morning of the eleventh, Perla drove forty-one minutes east to my house and then drove back west past her own subdivision to a shopping centre twenty minutes from her home.<\/p>\n

<\/div>\n

Two.<\/strong>\u00a0Our mother lives eleven minutes from Perla and had offered to take Esme that day.<\/p>\n

<\/p>\n

I did not know this on the eleventh.<\/p>\n

<\/div>\n

My mother told me on the nineteenth, unprompted, in a kitchen, in the tone of someone mentioning a small odd thing.<\/p>\n

Three.<\/strong>\u00a0Perla passed at least three immediate care centres between her house and mine.<\/p>\n

Four.<\/strong>\u00a0Curtis went to the mall with her.<\/p>\n

A man goes to a shopping centre with his wife on a Saturday morning when the baby is at her sister’s.<\/p>\n

<\/div>\n

That is not strange.<\/p>\n

<\/p>\n

Unless.<\/p>\n

<\/div>\n

Five.<\/strong>\u00a0At two in the morning that same night, by his own account, something had happened to that leg and the child had screamed.<\/p>\n

Six.<\/strong>\u00a0By Perla’s own later admission, she had noticed before leaving the house that Esme was not moving the left leg, and had seen a mark.<\/p>\n

Seven.<\/strong>\u00a0She gave her infant Tylenol at approximately eight in the morning.<\/p>\n

<\/div>\n

She volunteered this to DCFS herself.<\/p>\n

<\/p>\n

Eight.<\/strong>\u00a0She told me it was teething.<\/p>\n

<\/div>\n

Nine.<\/strong>\u00a0She said eleven words in my doorway that were, in effect, a delegation of medical decision-making to me.\u00a0You decide.<\/em><\/p>\n

You’ve always been the decider.<\/p>\n

Ten.<\/strong>\u00a0Within ninety seconds of hearing the word femur, her husband asked whether the X-ray could establish a time.<\/p>\n

Eleven.<\/strong>\u00a0Within a further ninety seconds, my sister told a physician that the baby had been perfectly fine when she left her with me.<\/p>\n

<\/div>\n

Twelve.<\/strong>\u00a0An hour later she leaned into my ear and asked me to say I had found it after they left.<\/p>\n

<\/p>\n

Twelve things.<\/p>\n

<\/div>\n

Every one of them true.<\/p>\n

Every single one of them independently verifiable and eleven of them documented.<\/p>\n

And the conclusion I drew from them, which I held with total conviction for about sixteen weeks, was this:<\/p>\n

That my sister and her husband knew the child was badly injured; that they understood that whoever presented her at a hospital would be inside the timeline; that they therefore selected the one relative in the family who would not telephone before acting; that they drove past a grandmother and three urgent care centres to deliver her to that person; and that they then placed themselves together, in public, on camera, with receipts, for the duration of the window they had just created.<\/p>\n

<\/div>\n

I want to record how that theory felt, because it is the only way anybody will understand why I could not put it down.<\/p>\n

<\/p>\n

It felt like relief.<\/p>\n

<\/div>\n

It explained the drive.<\/p>\n

It explained the mall.<\/p>\n

It explained the eleven words.<\/p>\n

It explained why nobody had called a doctor for eight hours.<\/p>\n

It explained the whisper.<\/p>\n

And \u2014 this is the part I could not see at the time and can see now \u2014 it explained me.<\/p>\n

<\/div>\n

It took a woman who had spent three days going through an hour and sixteen minutes in her own head, minute by minute, checking her own hands, and it gave her a role.<\/p>\n

<\/p>\n

I was not a person who could not be excluded.<\/p>\n

<\/div>\n

I was a person who had been used.<\/p>\n

Those are extremely different things to be, and only one of them lets you sleep, and I chose the one that let me sleep and then I spent four months finding evidence for it.<\/p>\n

Part Thirteen: How a Baby Actually Ends Up in Your House<\/strong><\/p>\n

People imagine that a social worker hands you a child in a corridor.<\/p>\n

<\/div>\n

It is not like that and I want to set out what it is like, because the process is the story for the next eighteen months and almost nobody knows any of it.<\/p>\n

<\/p>\n

On the fourteenth of October, DCFS took protective custody of Esme Bellew.<\/p>\n

<\/div>\n

That is an administrative act; it happens before any judge sees anything.<\/p>\n

Within forty-eight hours of that, there is a hearing.<\/p>\n

In Illinois it is called a temporary custody hearing and everybody in the building calls it shelter care.<\/p>\n

It is held in the Juvenile Court on Hamilton Avenue, in a courtroom with no jury and about eleven people in it, and it took forty minutes.<\/p>\n

<\/div>\n

The State is represented.<\/p>\n

<\/p>\n

The parents are each represented; Perla and Curtis had separate attorneys from the first day, which I did not expect and which is standard, because their interests are not the same and everybody in that building knows it before they do.<\/p>\n

<\/div>\n

And the child is represented.<\/p>\n

That is the part nobody outside the system knows about.<\/p>\n

In Cook County a minor in a case like this gets the Office of the Public Guardian, and that office has its own lawyers, and those lawyers do not work for the State and do not work for the parents and are not there to be reasonable.<\/p>\n

<\/div>\n

They act for the baby.<\/p>\n

<\/p>\n

Esme’s was a woman named Marguerite Stiles and she was, over eighteen months, the most consistently unpleasant person I dealt with and the one I would want if it were my child.<\/p>\n

<\/div>\n

The judge found probable cause and immediate and urgent necessity, which is the statutory language, and placed the child in the temporary custody of the guardianship administrator of DCFS.<\/p>\n

Which means the State has her, and then the State has to put her somewhere.<\/p>\n

The preference, by statute and by policy and by every piece of research anybody has done, is a relative.<\/p>\n

<\/div>\n

There is a formal process for it called relative placement and it is not the same thing as foster licensing, and both of them apply, in sequence, and it is a great deal of paperwork.<\/p>\n

<\/p>\n

Here is what Hugo and I did in eleven days.<\/p>\n

<\/div>\n

Background checks, both of us \u2014 state police, FBI fingerprints, the child abuse registry in every state either of us has lived in, which for Hugo meant Texas.<\/p>\n

A home safety check, which is a woman with a clipboard walking through your house looking at outlet covers, smoke detectors, the water heater temperature, whether there are medications within reach, whether there are firearms, and where the child would sleep.<\/p>\n

<\/div>\n

Financial documentation.<\/p>\n

<\/p>\n

Employment verification.<\/p>\n

<\/div>\n

A physician’s letter for each of us stating we were physically capable.<\/p>\n

Three references who were not family.<\/p>\n

And a home study, which is an interview about your own childhood, conducted by a stranger, in your living room, for two and a half hours.<\/p>\n

I was asked in that interview whether I had children of my own, and why not, and I answered, and it is in a file somewhere in a building on Michigan Avenue.<\/p>\n

<\/div>\n

Esme came to our house on the twenty-second of October.<\/p>\n

<\/p>\n

She was six months and twenty-two days old and she had been in hospital for eleven days and she came with a hip abduction brace, a follow-up schedule, a DCFS placement packet, and a diaper bag my sister had packed.<\/p>\n

<\/div>\n

That bag is the thing I cannot write about properly even now.<\/p>\n

Perla had put in the specific pacifier, and the muslin with the frayed corner, and a small knitted rabbit, and a note in her handwriting about the feeding times.<\/p>\n

A woman under investigation for endangering her daughter packed a bag for her, correctly, with the right rabbit.<\/p>\n

Both of those are true and I have had four years and I still cannot put them in the same sentence without stopping.<\/p>\n

<\/div>\n

The first three nights I narrated everything.<\/p>\n

<\/p>\n

“I’m going to pick you up now.”<\/p>\n

<\/div>\n

“I’m going to change your diaper now.”<\/p>\n

“I’m going to move your leg a little bit.<\/p>\n

Here we go.”<\/p>\n

I did it because I read it somewhere at two in the morning on a phone and because I could not think of anything else to do, and I have since found out from Imogen Achara that it is actually a real thing and is recommended, which surprised me.<\/p>\n

<\/div>\n

She said: “You weren’t doing it for her comprehension.<\/p>\n

<\/p>\n

You were doing it so that a pair of hands would stop arriving without warning.<\/p>\n

<\/div>\n

That is exactly right and I would like to know where you read it.”<\/p>\n

I could not remember.<\/p>\n

I still cannot.<\/p>\n

Part Fourteen: My Parents<\/strong><\/p>\n

My mother is Yolanda Restrepo and she was sixty-six that October and she offered to take Esme that Saturday and was told no.<\/p>\n

She told me on the nineteenth, standing at her own kitchen counter, in the middle of something else entirely, and she did not know what she was handing me.<\/p>\n

<\/div>\n

She said: “I said I’d have her.<\/p>\n

<\/p>\n

On the Saturday.<\/p>\n

<\/div>\n

I’d said it on the Wednesday and she said no, she’d take her to you, because you were closer to something.”<\/p>\n

“Closer to what?”<\/p>\n

And my mother said, “I don’t know.<\/p>\n

She said it fast.”<\/p>\n

I wrote that down in my car.<\/p>\n

My parents’ position for the first eleven weeks was that I was destroying the family, and I want to represent it fairly, because it is the position that almost every family takes and it is not stupid and it does not come from nowhere.<\/p>\n

<\/div>\n

My father said it once, properly, in the November, and then never again.<\/p>\n

<\/p>\n

He is Aureliano Restrepo and everybody calls him Lalo and he was sixty-nine and he came to Illinois from Medell\u00edn when he was twenty-four and he has spent forty-five years avoiding institutions of every kind for reasons that are entirely rational given where he grew up.<\/p>\n

<\/div>\n

He said: “Mija.<\/p>\n

You have brought the state into this family.”<\/p>\n

And I said, “Papi, a hospital brought the state into this family.<\/p>\n

It’s a law.<\/p>\n

Dr.<\/p>\n

Adeyemi had to call before he even spoke to me.”<\/p>\n

<\/div>\n

And he said: “And then you kept talking to them.”<\/p>\n

<\/p>\n

That is the whole of my father’s objection and it took him four words and it is, I have come to think, the most honest version of the position anybody offered me.<\/p>\n

<\/div>\n

Not that Esme had not been hurt.<\/p>\n

He never once said that.<\/p>\n

Not that Perla was innocent, which he also never said.<\/p>\n

That there are two categories of thing in the world \u2014 family problems and state problems \u2014 and that once a thing crosses from the first to the second you never get it back, and that I had held the door.<\/p>\n

<\/div>\n

He is right about that, incidentally.<\/p>\n

<\/p>\n

That is exactly what happens and it is not reversible and nobody in that system ever pretended otherwise.<\/p>\n

<\/div>\n

My mother’s position was different and it was the one that hurt.<\/p>\n

She did not defend Curtis.<\/p>\n

What she said, in about nine different formulations over three months, was: “She is my daughter too.”<\/p>\n

And on the eleventh of December, in my kitchen, she said the thing that took ten weeks to arrive and that I think she had been assembling the whole time.<\/p>\n

<\/div>\n

She said: “You have my granddaughter in your house, and my daughter is on a supervised visit list, and you are the reason for both, and I am supposed to be grateful to you, and I am, and I would like you to understand what it costs me to say it.”<\/p>\n

<\/p>\n

What changed them was not me.<\/p>\n

<\/div>\n

I want that in the account because I spent about two months trying.<\/p>\n

What changed them was the repeat skeletal survey in the November \u2014 two more ribs, older \u2014 and the fact that my mother went, on her own, without telling anybody, to a supervised visit at the DCFS facility in Maywood and sat in the room and watched.<\/p>\n

She came to my house afterward and did not take her coat off and stood in my hallway and said: “There is a woman in that room whose job is to write down what happens.<\/p>\n

<\/div>\n

“And my daughter spent an hour looking at her instead of at the baby.”<\/p>\n

<\/p>\n

After that my father started leaving boxes of diapers on the porch without ringing the bell, which is how that man conducts an apology, and my mother started coming on Thursdays.<\/p>\n

<\/div>\n

Neither of them has ever said they were wrong in the first eleven weeks and I have never asked them to.<\/p>\n

Part Fifteen: The Nineteenth of February<\/strong><\/p>\n

I gave them the theory on the nineteenth of February, in a small room in a DCFS office in Maywood, in an interview I attended without my attorney because Rosalind Vey was in trial and I did not want to wait nine days.<\/p>\n

<\/div>\n

I want to describe how I did it, because the manner of it is the part that did the damage.<\/p>\n

<\/p>\n

I did not blurt it out.<\/p>\n

<\/div>\n

I had typed it.<\/p>\n

Six pages, numbered paragraphs, twelve enumerated facts with a source for each one \u2014 a date, a document, a person, a time.<\/p>\n

Because that is what I do.<\/p>\n

Because for sixteen years I have made records that other people rely on and I am extremely good at it and I know what a clean exhibit looks like.<\/p>\n

<\/div>\n

I handed a copy to Dovie Mwangi and I read it out.<\/p>\n

<\/p>\n

And at the end of it \u2014 paragraph thirteen, which was the only paragraph in six pages that was not a fact \u2014 I said:<\/p>\n

<\/div>\n

“It is my belief that Esme was brought to my house in order that the injury would be discovered while she was in my care, and that the trip to the shopping centre was undertaken in order to establish the whereabouts of both parents during that period.”<\/em><\/p>\n

Dovie Mwangi read the document.<\/p>\n

She took about four minutes to do it, which I remember because nobody said anything.<\/p>\n

<\/div>\n

Then she put it down and she said: “Ms.<\/p>\n

<\/p>\n

Restrepo, can I ask you something before I respond to any of it?”<\/p>\n

<\/div>\n

“Yes.”<\/p>\n

And she said: “Do you think your sister is a person who plans?”<\/p>\n

I said something about it not requiring much planning.<\/p>\n

And Dovie Mwangi said: “That’s not what I asked.”<\/p>\n

Then she said: “I’m going to take this and put it in the file, because that’s my job and because you’re a reporting witness and I don’t get to decide what’s relevant.<\/p>\n

<\/div>\n

“And I want to tell you one thing and you’re not going to like it and I’m going to say it anyway, because I’ve been doing this for nineteen years.<\/p>\n

<\/p>\n

“You’ve handed me six pages of evidence about your niece’s injury with one paragraph at the end about your own innocence, and the paragraph at the end is the only one that isn’t sourced, and it’s the only one you read out twice.”<\/p>\n

<\/div>\n

I said I had not read it twice.<\/p>\n

And she said, “You did.”<\/p>\n

I checked, afterward, against my own memory, for about a week, and I could not resolve it, which is its own answer.<\/p>\n

Part Sixteen: What the Detective Said<\/strong><\/p>\n

Detective Sal Bonaventura called me on the second of March and asked me to come in, and Rosalind Vey came with me, and I assumed I was in trouble.<\/p>\n

<\/div>\n

I was not in trouble.<\/p>\n

<\/p>\n

He had read the six pages.<\/p>\n

<\/div>\n

He is about fifty-five and he has been in that unit for eleven years and he has the specific flat kindness of a man who has told several hundred people something they did not want to hear.<\/p>\n

He said: “Ms.<\/p>\n

Restrepo, I want to go through your document.<\/p>\n

Not because there’s anything wrong with you making it.<\/p>\n

I’d rather have it than not.<\/p>\n

<\/div>\n

But you’ve built a theory and I’m going to take it apart, and I’d rather do it in a room than have you carry it around for another year.”<\/p>\n

<\/p>\n

It took him about twenty minutes and I am going to give it as close to the way he said it as I can.<\/p>\n

<\/div>\n

He said: “First thing.<\/p>\n

An alibi for eleven in the morning is worthless in a case like this and everybody finds that out in about four days.<\/p>\n

“Nobody in this building has ever thought the injury happened at eleven in the morning.<\/p>\n

The swelling told the doctor that on day one.<\/p>\n

The mall receipts don’t do anything for anybody.<\/p>\n

If they built this, they built it out of a material that doesn’t hold weight, and your brother-in-law is not a stupid man.<\/p>\n

<\/div>\n

“Second thing, and this is the one I want you to sit with.<\/p>\n

<\/p>\n

“On day three, Curtis Bellew walked up to you in a corridor with a cup of coffee and told you about two in the morning.<\/p>\n

<\/div>\n

Nobody asked him.<\/p>\n

He hadn’t been interviewed yet.<\/p>\n

He gave a time, a mechanism and a scream, unprompted, to a witness he knew was talking to us.<\/p>\n

“I have been doing this for eleven years.<\/p>\n

People executing a plan do not do that.<\/p>\n

That is the single most self-damaging thing anybody said in this case and he said it voluntarily on day three, and the reason people do that is not strategy.<\/p>\n

<\/div>\n

It’s that they cannot stand holding it.<\/p>\n

<\/p>\n

“Third.<\/p>\n

<\/div>\n

The ribs are two to five weeks old and there were three of them.<\/p>\n

There is no window anywhere in October that helps anybody with a rib from September.<\/p>\n

A frame that leaves three healing ribs on the film is not a frame.”<\/p>\n

Then he said the thing that took the floor out.<\/p>\n

“And fourth.<\/p>\n

If somebody in that house had wanted to build a story, there was an obvious one available and it costs nothing.<\/p>\n

<\/div>\n

“You take her to an emergency room yourself at eight in the morning and you say she rolled off the couch onto a tile floor about an hour ago.<\/p>\n

<\/p>\n

“That’s the play.<\/p>\n

<\/div>\n

That is what people do.<\/p>\n

I get that one about nine times a year and it is very hard to disprove in an isolated femur and it puts the parents in the room being helpful instead of being interviewed separately.<\/p>\n

“They didn’t do it.<\/p>\n

Nobody took her anywhere for eight hours.<\/p>\n

They gave her Tylenol and drove her to your house.”<\/p>\n

<\/div>\n

I said something.<\/p>\n

<\/p>\n

I do not remember what.<\/p>\n

<\/div>\n

And Detective Bonaventura said: “Ms.<\/p>\n

Restrepo, here’s what I think happened and I’ll tell you I can’t prove the last bit and I’m not going to try.<\/p>\n

“I think your sister knew that baby was badly hurt by about six in the morning and could not make herself be the person who walked into a hospital with her.<\/p>\n

“Because the second you do that, they ask you what happened, and the true answer involves your husband, and you have to say it out loud to a stranger with a badge, and then it’s real and it’s started and it never stops.<\/p>\n

<\/div>\n

“So she drove forty-one minutes and handed her to the one person in the family who she knew, absolutely knew, would not wait for permission.<\/p>\n

<\/p>\n

“That’s not a frame.<\/p>\n

<\/div>\n

That is somebody arranging for her daughter to get to a hospital in the only way she was capable of doing it.<\/p>\n

“It’s cowardice.<\/p>\n

It’s serious.<\/p>\n

In this state it’s a crime and she’s going to be charged with it.<\/p>\n

But it is not what you wrote in paragraph thirteen, and paragraph thirteen is going to be in this file forever.”<\/p>\n

<\/div>\n

I sat in the car afterward for about twenty minutes and Rosalind Vey sat with me and did not say anything for the first ten.<\/p>\n

<\/p>\n

Then she said: “Do you want the lawyer thing or the human thing?”<\/p>\n

<\/div>\n

I said the lawyer thing.<\/p>\n

And she said: “Paragraph thirteen is now a prior inconsistent theory attributed to a State witness, and the first defence attorney who finds it is going to put it in front of a judge, and you have no idea which side it hurts.”<\/p>\n

Part Seventeen: Page Four<\/strong><\/p>\n

I found it myself, eleven days later, on the thirteenth of March, at my own kitchen table at about ten at night, and I have never had a worse four minutes.<\/p>\n

<\/div>\n

Rosalind had asked me to put together a complete chronology of every statement I had made to anybody \u2014 dates, audiences, and content \u2014 because she wanted to know what was out there before somebody else did.<\/p>\n

<\/p>\n

So I was working through it in order, from my own records, and I got to the interview with Detective Bonaventura on the fifteenth of October, of which I had a page of my own notes made the same evening.<\/p>\n

<\/div>\n

And in my own handwriting it says:\u00a0told B she was already whimpering at the door, P was rushing.<\/em><\/p>\n

And then I opened the note from the parking structure, which I had read perhaps forty times without ever reading it.<\/p>\n

E fine on arrival as far as I saw, did not really look at her.<\/em><\/p>\n

I sat at that table for a long time.<\/p>\n

<\/div>\n

Here is what actually happened, and it took me about four months and Imogen Achara to be able to describe it without defending it.<\/p>\n

<\/p>\n

At nine forty-one in the morning on the eleventh of October, my sister handed me a baby and I looked at my sister.<\/p>\n

<\/div>\n

At ten fifty-nine that morning I wrote down, accurately, that I had not looked at the child.<\/p>\n

At two forty-four that afternoon my sister said a sentence that put me inside a window, and I said, out loud, in front of four medical professionals, that the baby had already been hurting when she was handed to me.<\/p>\n

And by the fifteenth of October, four days later, in a police station, I had a memory.<\/p>\n

<\/div>\n

Not a lie.<\/p>\n

<\/p>\n

I want to be extremely precise about that, because I have spent sixteen years being precise about it for other people.<\/p>\n

<\/div>\n

By the fifteenth of October I could see it.<\/p>\n

A small sound.<\/p>\n

A face.<\/p>\n

My sister’s hand adjusting the fleece.<\/p>\n

I could see it the way you see any memory, which is to say not very clearly and with complete conviction.<\/p>\n

It was not there on the eleventh.<\/p>\n

<\/div>\n

I know that because I wrote down that it was not.<\/p>\n

<\/p>\n

I made it between the eleventh and the fifteenth, out of terror, and I made it because I needed the injury to have started before nine forty-three, and I had it for four months and I gave it to two agencies and I would have sworn to it.<\/p>\n

<\/div>\n

I am a court reporter.<\/p>\n

My entire professional existence is built on the proposition that what people remember is unreliable and that only the record is worth anything.<\/p>\n

I have said that at dinner parties.<\/p>\n

I have said it to law students.<\/p>\n

I have been smug about it for sixteen years.<\/p>\n

And I did it anyway, inside four days, about the most important morning of my life, with a contemporaneous note sitting on my own phone.<\/p>\n

<\/div>\n

I called Rosalind Vey the next morning and told her and she said one word, which was “Right,” and then she said: “We disclose it.<\/p>\n

<\/p>\n

Today.<\/p>\n

<\/div>\n

In writing, from me, to everybody who’s had the other version.”<\/p>\n

I said something about how it made me look.<\/p>\n

And Rosalind Vey said: “Alma.<\/p>\n

Listen to me carefully, because this is the only piece of advice in this whole thing that actually matters.<\/p>\n

“A witness who corrects herself in March is a witness.<\/p>\n

A witness who is corrected by a defence attorney in October is a liar.<\/p>\n

<\/div>\n

“Those are the only two things you can be from here, and you get to choose today, and the choice closes the moment somebody else finds it.”<\/p>\n

<\/p>\n

We disclosed it on the fourteenth of March in a two-page letter that went to DCFS, to Detective Bonaventura, to the State’s Attorney’s office and to the Public Guardian.<\/p>\n

<\/div>\n

It is the most humiliating document I have ever been associated with and it is the reason I was still credible in the October.<\/p>\n

Part Eighteen: Mr. Fenneman<\/strong><\/p>\n

The adjudicatory hearing \u2014 the trial, in juvenile court, where the judge decides whether the allegations in the petition are proven \u2014 began on the eleventh of October 2023, one year to the day.<\/p>\n

<\/div>\n

I testified for three hours and twenty minutes.<\/p>\n

<\/p>\n

Kyle Fenneman represents Curtis Bellew.<\/p>\n

<\/div>\n

He is about forty-five and he was courteous to me throughout and he is extremely good at his job and I want to describe what he did, because I have watched four hundred cross-examinations from behind a machine and I had never once been on the other side of one.<\/p>\n

He did not attack the note.<\/p>\n

The note is a contemporaneous record made before anybody knew there was a case, and it is unassailable, and he knew it in about four seconds.<\/p>\n

<\/div>\n

He used it.<\/p>\n

<\/p>\n

He had me read it out.<\/p>\n

<\/div>\n

All one hundred and nine words, into a record, in my own voice.<\/p>\n

Including\u00a0E fine on arrival as far as I saw, did not really look at her.<\/em><\/p>\n

Then he took me through the fifteenth of October and had me confirm what I had told the detective.<\/p>\n

Then he had me confirm that I had corrected it, in March, voluntarily, through counsel.<\/p>\n

<\/div>\n

And then he said: “Ms.<\/p>\n

<\/p>\n

Restrepo, you’re a court reporter.”<\/p>\n

<\/div>\n

“Yes.”<\/p>\n

“Sixteen years.”<\/p>\n

“Yes.”<\/p>\n

“Your profession is the accurate preservation of what people say.”<\/p>\n

“Yes.”<\/p>\n

“And within four days of this event, you told a police detective something about this child that your own contemporaneous note contradicts.”<\/p>\n

<\/div>\n

“Yes.”<\/p>\n

<\/p>\n

“Were you lying to Detective Bonaventura?”<\/p>\n

<\/div>\n

And I said: “No. I believed it.”<\/p>\n

And Kyle Fenneman said: “Exactly.”<\/p>\n

And sat down for a second, and then stood up again, and went to paragraph thirteen.<\/p>\n

He read it into the record.<\/p>\n

He had me confirm I wrote it.<\/p>\n

He had me confirm I had delivered it in person to a DCFS investigator on the nineteenth of February.<\/p>\n

<\/div>\n

He had me confirm that no agency had adopted it and that the investigating detective had specifically rejected it.<\/p>\n

<\/p>\n

And then he asked me whether I still believed it.<\/p>\n

<\/div>\n

And I said, “No.”<\/p>\n

“When did you stop?”<\/p>\n

“The second of March.”<\/p>\n

“What changed on the second of March?”<\/p>\n

“A detective explained to me why it was wrong.”<\/p>\n

“So a police officer had to talk you out of a theory you had constructed about your own sister.”<\/p>\n

<\/div>\n

“Yes.”<\/p>\n

<\/p>\n

He let that sit in the room for about three seconds, which is exactly the right amount, and then he thanked me and sat down.<\/p>\n

<\/div>\n

Marguerite Stiles \u2014 the Public Guardian’s attorney, the one who acted for Esme, the one I had found unpleasant for a year \u2014 stood up on redirect and asked me four questions and it took ninety seconds.<\/p>\n

“Ms.<\/p>\n

Restrepo, did anyone ask you to correct your account?”<\/p>\n

“No.”<\/p>\n

“Who found the inconsistency?”<\/p>\n

“I did.”<\/p>\n

<\/div>\n

“When?”<\/p>\n

<\/p>\n

“The thirteenth of March.<\/p>\n

<\/div>\n

I disclosed it on the fourteenth.”<\/p>\n

“Did you have to?”<\/p>\n

“No.”<\/p>\n

And she sat down.<\/p>\n

Afterward, in the corridor, she said the only warm thing she said to me in eighteen months.<\/p>\n

She said: “That was the best hour of testimony in this case and it was the hour where you were wrong.”<\/p>\n

<\/div>\n

Part Nineteen: Hamilton Avenue<\/strong><\/p>\n

<\/p>\n

Eighteen months of juvenile court is not eighteen months of hearings.<\/p>\n

<\/div>\n

It is eighteen months of a waiting room.<\/p>\n

I want to describe it, because every account of a case like this cuts from the hospital to the verdict, and the thing in between is where the actual damage is done, and nobody writes it down.<\/p>\n

The Juvenile Center on Hamilton Avenue is a large building and the waiting area outside the courtrooms has rows of connected plastic chairs and a vending machine and a television mounted high in one corner that is always on and always muted.<\/p>\n

<\/div>\n

We were there, between October 2022 and March 2024, on twenty-three occasions.<\/p>\n

<\/p>\n

Here is what those twenty-three occasions consisted of.<\/p>\n

<\/div>\n

Four of them were substantive.<\/p>\n

Shelter care.<\/p>\n

Adjudication, which was two days.<\/p>\n

Disposition.<\/p>\n

Permanency.<\/p>\n

Nineteen of them were not.<\/p>\n

<\/div>\n

Nineteen times I took a day off work, arranged childcare for a baby, drove into the city, parked in a structure that cost twenty-two dollars, sat on a connected plastic chair from eight forty-five in the morning, and was told at some point between ten and two that the matter was continued.<\/p>\n

<\/p>\n

Continued because a parent’s attorney was on trial in another building.<\/p>\n

<\/div>\n

Continued because the State needed an expert report that had not arrived.<\/p>\n

Continued because a service was not documented.<\/p>\n

Continued once because there was no interpreter available for an unrelated case ahead of ours and the call sheet collapsed.<\/p>\n

Once, in the June of 2023, we were continued because the judge was ill and the substitute would not take a contested matter.<\/p>\n

<\/div>\n

I calculated it, because that is the kind of person I am.<\/p>\n

<\/p>\n

Across eighteen months I spent approximately a hundred and forty hours in that building and approximately nine of them in a courtroom.<\/p>\n

<\/div>\n

And here is the part that nobody who has not done it can imagine.<\/p>\n

Everybody waits in the same room.<\/p>\n

There is no separate area.<\/p>\n

My sister and I sat in that waiting area, on the same bank of chairs, twenty-three times, sometimes four feet apart, sometimes four hours.<\/p>\n

Curtis was there too, until he was in custody, sitting at the far end with Kyle Fenneman.<\/p>\n

<\/div>\n

My parents came to eleven of them.<\/p>\n

<\/p>\n

So the arrangement, on a Tuesday morning in a public building in Chicago, was: a woman, her sister whom she had accused in writing of orchestrating an injury to a child, that sister’s husband who had broken the child’s femur, and their parents \u2014 in one room, with a muted television, for four hours, waiting to be told it was not happening today.<\/p>\n

<\/div>\n

You do not talk.<\/p>\n

That is the etiquette and everybody arrives at it independently within about three visits.<\/p>\n

You bring something to read that you do not read.<\/p>\n

You go and stand by the window at different times.<\/p>\n

The second time, in the November of 2022, my mother tried to make us sit together and it was unbearable for about nine minutes and she never tried again.<\/p>\n

<\/div>\n

The eleventh time, in the July of 2023, Perla went to the vending machine and came back and put a bottle of water on the chair next to me without saying anything and went and sat down at the other end.<\/p>\n

<\/p>\n

I did not drink it.<\/p>\n

<\/div>\n

I took it home and it was in my car for about four months.<\/p>\n

Marguerite Stiles told me once, in that waiting area, while we were both standing by the window, the only piece of context anybody gave me about the delay.<\/p>\n

She said: “You’re angry about the continuances.<\/p>\n

Everybody is.<\/p>\n

“Here’s what I’d want you to know.<\/p>\n

That calendar has about four thousand children on it.<\/p>\n

<\/div>\n

Every single continuance you sit through is somebody else’s case getting the day it needs.<\/p>\n

<\/p>\n

“And about a third of them are cases where a parent is doing the work and needs more time, and if this building ran fast, those children would lose their parents on a schedule instead of on the merits.<\/p>\n

<\/div>\n

“The slowness is not a failure of the system.<\/p>\n

It’s most of what’s decent about it, and it is also going to cost you a hundred and forty hours of your life, and both of those are true.”<\/p>\n

I have thought about that more than almost anything anybody said to me in that building.<\/p>\n

It is the same shape as everything else in this account.<\/p>\n

<\/div>\n

Two things that are both true, sitting next to each other, refusing to resolve.<\/p>\n

<\/p>\n

Esme was in my house for five hundred and eleven days before a judge entered a permanent order about where she lived.<\/p>\n

<\/div>\n

She learned to sit up, to crawl, to walk, to say eleven words, to climb the third stair, and to say\u00a0T\u00eda<\/em>\u00a0during a period in which her legal status was, formally and on paper, temporary.<\/p>\n

 <\/p>\n

Part Twenty: What Actually Happened That Morning<\/strong><\/p>\n

I got it from my sister, in pieces, across about two years, and most of it in one sitting in the June of 2024 in a room at a family therapy practice in Elmhurst with a third person present, which is the only way she and I are permitted to have that kind of conversation and which I now think is the only way anybody should.<\/p>\n

<\/div>\n

Some of it I have from the DCFS file and from her own statements.<\/p>\n

<\/p>\n

Where the two conflict I have used the contemporaneous version, because that is what I do.<\/p>\n

<\/div>\n

Here is the morning.<\/p>\n

2:04 a.m.<\/strong>\u00a0Curtis does a diaper change in the nursery.<\/p>\n

Esme screams.<\/p>\n

Not a cry \u2014 a scream, and he has never once disputed this.<\/p>\n

Perla is in bed and hears it and comes to the door.<\/p>\n

He says: “She’s all right.<\/p>\n

<\/div>\n

She got her leg caught.”<\/p>\n

<\/p>\n

She looks at the baby for, by her own estimate, under thirty seconds.<\/p>\n

<\/div>\n

Esme is upset and is being held.<\/p>\n

She goes back to bed.<\/p>\n

2:20 to 4:00 a.m.<\/strong>\u00a0Esme cries on and off.<\/p>\n

Curtis settles her.<\/p>\n

Perla sleeps for about an hour.<\/p>\n

4:10 a.m.<\/strong>\u00a0Perla gets up and takes over.<\/p>\n

<\/div>\n

Esme will not settle in the usual position.<\/p>\n

<\/p>\n

She settles on her back with the left leg still.<\/p>\n

<\/div>\n

Perla told me she noticed that.<\/p>\n

She told me she thought:\u00a0she’s just tired.<\/em><\/p>\n

6:30 a.m.<\/strong>\u00a0A diaper change.<\/p>\n

And this is the moment.<\/p>\n

This is where, if you are looking for a moment, the moment is.<\/p>\n

She lifts her daughter’s hips and the left leg does not move with the right leg.<\/p>\n

<\/div>\n

She has told me that she saw it and that she knew it was wrong and that what she thought \u2014 and she has been very clear that this is what she actually thought and not what she constructed afterward \u2014 was:\u00a0oh no.<\/em><\/p>\n

<\/p>\n

Not\u00a0oh no, she’s hurt.<\/em><\/p>\n

<\/div>\n

Oh no.<\/em><\/p>\n

7:00 a.m.<\/strong>\u00a0She looks at the thigh.<\/p>\n

She sees a mark at the diaper edge.<\/p>\n

7:15 a.m.<\/strong>\u00a0She asks Curtis directly.<\/p>\n

She asked him one question and she has never been able to tell me what her voice sounded like when she asked it.<\/p>\n

And he said: “She got her leg caught in the strap.<\/p>\n

<\/div>\n

She’s fine.<\/p>\n

<\/p>\n

She was fine after.”<\/p>\n

<\/div>\n

And my sister said \u2014 and this is the sentence that I think is the actual centre of this entire account \u2014<\/p>\n

“Okay.”<\/p>\n

7:40 a.m.<\/strong>\u00a0Infant acetaminophen, correct weight-based dose.<\/p>\n

She looked it up.<\/p>\n

She is not careless.<\/p>\n

8:02 a.m.<\/strong>\u00a0She telephones our mother and cancels.<\/p>\n

<\/div>\n

I asked her why, in that room in Elmhurst, and she gave me the only answer she has ever given that I believe entirely and immediately.<\/p>\n

<\/p>\n

She said: “Because Mami would have taken her coat off.”<\/p>\n

<\/div>\n

I said I did not understand.<\/p>\n

And Perla said: “She’d have come in and taken her coat off and sat down and unwrapped her and she’d have said\u00a0Perlita, what is this<\/em>, and then she’d have looked at Curtis.<\/p>\n

In my kitchen.<\/p>\n

And she’d have asked him.<\/p>\n

“And I could not be in a room where my mother asked my husband that question.”<\/p>\n

<\/div>\n

8:20 a.m.<\/strong>\u00a0She searches on her phone.<\/p>\n

<\/p>\n

The history was recovered.<\/p>\n

<\/div>\n

Four searches in eleven minutes.<\/p>\n

I am not going to reproduce them; two of them are the ones you would expect and two of them are worse and they are in a file.<\/p>\n

She read for eleven minutes and then she stopped.<\/p>\n

8:47 a.m.<\/strong>\u00a0She puts Esme in the car.<\/p>\n

9:41 a.m.<\/strong>\u00a0My doorstep.<\/p>\n

And this is what I got wrong for four months, and I want to set the two versions side by side one time.<\/p>\n

<\/div>\n

What I believed:<\/strong>\u00a0she selected me because I would be inside the window, and delivered the child, and constructed a joint public alibi for the duration.<\/p>\n

<\/p>\n

What happened:<\/strong>\u00a0she drove to the one person she was certain would take her daughter to a hospital without asking her permission first, and then she left, because she could not be there when it happened.<\/p>\n

<\/div>\n

The mall was not an alibi.<\/p>\n

I have the receipts now \u2014 they are in the file \u2014 and they show a coffee at 10:52 and nothing else for two hours.<\/p>\n

They did not shop.<\/p>\n

They sat.<\/p>\n

Curtis had said, at about nine o’clock: “Let’s just get out of the house.”<\/p>\n

And Perla said yes, because she could not sit in her own kitchen waiting for a telephone to ring.<\/p>\n

<\/div>\n

She said it to me in that room, and she said it flatly, and it is the only time she has ever said anything about that day that did not sound like it had been through a lawyer.<\/p>\n

<\/p>\n

“I wasn’t giving myself an alibi, Alma.<\/p>\n

<\/div>\n

I was getting out of the room.<\/p>\n

“I’ve done it my whole life.<\/p>\n

I did it when Papi was ill.<\/p>\n

I did it when my friend’s marriage ended.<\/p>\n

I am not a person who stays in the room, and this time the room had my daughter in it.”<\/p>\n

And the eleven words in the doorway.<\/p>\n

<\/div>\n

I asked her about those, because I had turned them into the keystone of a conspiracy, and I needed to know.<\/p>\n

<\/p>\n

And my sister looked completely blank and said: “What eleven words?”<\/p>\n

<\/div>\n

I said them to her.\u00a0If she gets too upset, you decide.<\/em><\/p>\n

You’ve always been the decider.<\/p>\n

And Perla said: “I don’t remember saying that.”<\/p>\n

I have thought about that more than almost anything.<\/p>\n

I built sixteen weeks on a sentence, and I preserved it perfectly, verbatim, the way I preserve everything, and I was right about every syllable of it.<\/p>\n

<\/div>\n

And the woman who said it does not remember saying it, and I believe her, because I have spent sixteen years watching people not remember what they said four minutes ago.<\/p>\n

<\/p>\n

A verbatim record of what somebody said is not a record of what they meant.<\/p>\n

<\/div>\n

I have known that professionally since I was twenty-two.<\/p>\n

It took me until I was forty to know it about my own family.<\/p>\n

Part Twenty-One: The Choice She Did Not Make<\/strong><\/p>\n

The service plan is a document.<\/p>\n

It is not a threat and it is not a negotiation; it is a list of tasks, and if a parent completes them the agency has to move toward reunification, and if she does not, it does not.<\/p>\n

<\/div>\n

Perla’s had six tasks on it.<\/p>\n

<\/p>\n

Parenting classes.<\/p>\n

<\/div>\n

A psychological evaluation.<\/p>\n

Individual counselling.<\/p>\n

Cooperation with the investigation.<\/p>\n

Consistent visitation.<\/p>\n

And one more.<\/p>\n

Establish and maintain a residence separate from Curtis Bellew for the duration of the pending criminal matter.<\/em><\/p>\n

<\/div>\n

That is all.<\/p>\n

<\/p>\n

Not divorce him.<\/p>\n

<\/div>\n

Not testify against him.<\/p>\n

Not say he did it.<\/p>\n

Live somewhere else while the State of Illinois works out whether the man in your house broke your daughter’s femur.<\/p>\n

Dovie Mwangi explained it to her in a family meeting in the January and I was in the room, which I will not apologize for, because the Public Guardian asked that the relative caregiver attend and I attended.<\/p>\n

<\/div>\n

And Curtis, who appeared by video because of the order of protection, said: “If she moves out, everybody’s going to assume I did it.”<\/p>\n

<\/p>\n

And Dovie Mwangi said \u2014 without any edge, in exactly the voice she uses to explain a form \u2014 “Mr.<\/p>\n

<\/div>\n

Bellew, the agency’s concern isn’t what people assume about you.<\/p>\n

It’s the child’s exposure to an unresolved risk.”<\/p>\n

She nearly did it.<\/p>\n

That is the thing nobody knows and that I have never said to my parents.<\/p>\n

In the March of 2023, my sister looked at an apartment in Glen Ellyn.<\/p>\n

She sent me a photograph of the kitchen.<\/p>\n

<\/div>\n

Two bedrooms, nine hundred and forty a month, eleven minutes from Esme’s physical therapy.<\/p>\n

<\/p>\n

She sent it at 11:40 at night with no message attached.<\/p>\n

<\/div>\n

I wrote back:\u00a0It’s good.<\/em><\/p>\n

The light’s good.<\/p>\n

And she wrote:\u00a0yeah<\/em><\/p>\n

And that was the entire exchange and she did not take it.<\/p>\n

I asked her, in Elmhurst, in 2024, what happened between the photograph and the not taking it.<\/p>\n

And she said: “I was going to.<\/p>\n

<\/div>\n

I had the application open.<\/p>\n

<\/p>\n

“And Curtis came in and asked what I was doing and I closed it, and he sat down and said ‘are you leaving me,’ and I said no.<\/p>\n

<\/div>\n

“And Alma, it wasn’t even a big conversation.<\/p>\n

It took about four minutes.<\/p>\n

He didn’t threaten me and he didn’t cry.<\/p>\n

He just asked, and I said no, because that was the easier four minutes.”<\/p>\n

The permanency hearing in the November of 2023 changed the goal.<\/p>\n

That is the language: the permanency goal.<\/p>\n

<\/div>\n

It had been\u00a0return home within twelve months<\/em>, which is the default and which the court prefers and which is what every part of that system is built to achieve.<\/p>\n

<\/p>\n

The judge changed it to\u00a0private guardianship<\/em>, and the guardian named was me.<\/p>\n

<\/div>\n

The reason, on the record, in about two sentences, was that the mother had completed five of six service plan tasks over thirteen months and had not completed the sixth and had indicated no intention to.<\/p>\n

Perla was in the courtroom.<\/p>\n

She had done the classes.<\/p>\n

She had done the evaluation.<\/p>\n

She had been to fifty-one supervised visits in thirteen months and had missed four, two of which were a car and two of which were flu.<\/p>\n

<\/div>\n

Five out of six.<\/p>\n

<\/p>\n

She looked at me across that courtroom when the judge said it and she said, out loud, not shouting, “This is what you wanted.”<\/p>\n

<\/div>\n

And the judge said, “Ma’am.”<\/p>\n

And she sat down.<\/p>\n

Part Twenty-Two: Curtis<\/strong><\/p>\n

He was charged in the January of 2023 with aggravated battery to a child, a Class X felony in Illinois, which carries six to thirty years.<\/p>\n

In the August of 2024 \u2014 twenty-two months in \u2014 he pleaded guilty to aggravated domestic battery, a Class 2, and was sentenced to four years in the Department of Corrections.<\/p>\n

<\/div>\n

With day-for-day credit and time served he did about nineteen months.<\/p>\n

<\/p>\n

He was released in the spring of 2026.<\/p>\n

<\/div>\n

I want to say a few things about that outcome, because everybody I have told has had the same reaction and it is not the right one.<\/p>\n

Four years is not a small number in that building.<\/p>\n

Kyle Fenneman is very good and Curtis had no prior record and the State had a medical opinion, an unretracted statement, and no confession and no witness, and there was a real chance of an acquittal.<\/p>\n

<\/div>\n

Marguerite Stiles \u2014 who is not required to care about the criminal case at all and who does \u2014 told me at the time: “Every child abuse case in this county turns on a doctor’s report and a defendant who talks.<\/p>\n

<\/p>\n

You had both.<\/p>\n

<\/div>\n

That’s a good case and good cases plead out at four years, and the alternative is a trial where a jury decides whether a tired father might have caught a leg in a strap.”<\/p>\n

The ribs were never charged.<\/p>\n

Three healing posterior rib fractures in a six-month-old.<\/p>\n

Highly specific for inflicted injury.<\/p>\n

The single most damning finding in eleven hundred pages.<\/p>\n

<\/div>\n

And no charge, ever, against anybody.<\/p>\n

<\/p>\n

The reason is that you cannot date them to a day.<\/p>\n

<\/div>\n

Two to five weeks is a range, and in that range Esme Bellew was in the care of her mother, her father, both grandparents, and on one occasion an eighteen-year-old babysitter from three doors down who has never been suspected of anything by anybody.<\/p>\n

You cannot prove beyond a reasonable doubt that a specific person did a specific thing on a specific day when the window is three weeks wide and has six adults in it.<\/p>\n

<\/div>\n

Detective Bonaventura told me that in the March of 2023, before it happened, so that I would be ready.<\/p>\n

<\/p>\n

He said: “The ribs will never be charged.<\/p>\n

<\/div>\n

I want you to hear it from me now, because in about a year somebody’s going to tell you and you’re going to think somebody dropped it, and nobody dropped it.<\/p>\n

“That finding did its work.<\/p>\n

It’s the reason that baby is in your house.<\/p>\n

It’s the reason the juvenile court found what it found.<\/p>\n

It just can’t do the other job, and it was never going to.”<\/p>\n

<\/div>\n

He was right and it still sits in me.<\/p>\n

<\/p>\n

Somebody put their hands around my niece’s chest in September of 2022 and squeezed hard enough to break three ribs against her own spine, and that person has never been named by anybody, and there is a version of this where it was not Curtis Bellew, and I do not think about that version very often and when I do I have to go outside.<\/p>\n

<\/div>\n

Part Twenty-Three: Two Letters<\/strong><\/p>\n

Two letters arrived at two different houses in the April of 2023 and they are the reason I tell people about the State Central Register whenever anybody gives me an opening.<\/p>\n

Mine said\u00a0unfounded.<\/em><\/p>\n

It is one page.<\/p>\n

It says that the investigation concerning Alma Restrepo has been completed and that the allegation was determined to be unfounded and that the report will be expunged in accordance with the relevant section, and there is a case number and a signature block.<\/p>\n

<\/div>\n

It took six months.<\/p>\n

<\/p>\n

Six months from the eleventh of October to the eleventh of April, during which I was, formally, a person with an open child abuse investigation against her.<\/p>\n

<\/div>\n

Not a suspect.<\/p>\n

Not accused.<\/p>\n

A person with an open investigation, which is a category that does not appear in any novel and which about forty thousand adults occupy in this state at any given moment.<\/p>\n

In that six months I turned down two jobs.<\/p>\n

That is a thing I have not told anybody except Hugo and Rosalind Vey.<\/p>\n

Two agencies called me for depositions involving minors \u2014 a school district case and a pediatric malpractice matter \u2014 and I said I was not available, and I was available.<\/p>\n

<\/div>\n

I did it because I could not sit in a room and make a record of a case about a child while there was an open file with my name in it, and because I was terrified that somebody would find out and I would be the story.<\/p>\n

<\/p>\n

That is what six months of a pending finding costs a person who did nothing, and nobody compensates it, and I do not think anybody in that system knows it happens.<\/p>\n

<\/div>\n

My sister’s letter said\u00a0indicated.<\/em><\/p>\n

Two allegations.<\/p>\n

Substantial risk of physical injury, and failure to protect.<\/p>\n

Not the femur.<\/p>\n

Nobody ever alleged that Perla Restrepo broke her daughter’s leg and nobody ever will.<\/p>\n

What was indicated is that she knew or should have known her child was seriously injured and did not obtain medical care for approximately eight hours.<\/p>\n

<\/div>\n

Which is true.<\/p>\n

<\/p>\n

She has never contested it and she did not appeal.<\/p>\n

<\/div>\n

And here is what an indicated finding actually does, which I did not know and which Rosalind Vey had warned me about in week one and which I did not properly believe until I watched it happen to my sister.<\/p>\n

It goes in a registry.<\/p>\n

Not a public one \u2014 you cannot look anybody up.<\/p>\n

But it is checked.<\/p>\n

Every school district, every childcare centre, every hospital volunteer programme, every youth sports organization, every foster licensing process, every adoption, in this state and in most others, runs that check.<\/p>\n

<\/div>\n

Perla was a paraprofessional in a school district in DuPage County.<\/p>\n

<\/p>\n

She had been for six years.<\/p>\n

<\/div>\n

She worked with third-graders.<\/p>\n

She lost that job in the May of 2023, and she is barred from that work, and depending on the allegation class the record persists for many years and in some cases indefinitely, and the appeal window closed while she was doing five out of six tasks on a service plan.<\/p>\n

She now works in inventory at a distribution centre in Carol Stream on a four-to-midnight shift.<\/p>\n

<\/div>\n

I want to be careful how I put the next part, because I have had two years to get it right and I still am not sure I have.<\/p>\n

<\/p>\n

That finding is correct.<\/p>\n

<\/div>\n

Every word of it.<\/p>\n

A woman looked at her daughter’s leg at half past six in the morning and did not take her anywhere until she handed her to me at twenty to ten, and a child should not have to wait eight hours, and the registry exists for exactly that and it should.<\/p>\n

And I have watched the consequence of it land on a woman for three years, and the consequence is not proportionate to eight hours.<\/p>\n

<\/div>\n

It is proportionate to a category.<\/p>\n

<\/p>\n

She will be sixty and she will not be able to volunteer at her granddaughter’s school.<\/p>\n

<\/div>\n

I have said that out loud twice \u2014 once to Rosalind Vey and once to Dovie Mwangi \u2014 and both of them said essentially the same thing, which is that the alternative is a registry with judgement calls in it, and that a registry with judgement calls in it is worse.<\/p>\n

I think they are right.<\/p>\n

I think about it about once a month anyway.<\/p>\n

<\/div>\n

Part Twenty-Four: Hugo<\/strong><\/p>\n

<\/p>\n

My husband has been in this account eleven times and every one of them has been a sentence of advice, and that is a failure of mine and I am correcting it here.<\/p>\n

<\/div>\n

Hugo Barranco is forty-three.<\/p>\n

He runs a two-van HVAC service business out of a unit in Cicero with four employees.<\/p>\n

We have been married eleven years and together fourteen.<\/p>\n

On the eleventh of October 2022 he was at his brother’s helping with a deck and he got a text from me at 11:20 that said\u00a0at Childrens with Esme her leg is broken can you come<\/em>\u00a0and he was there in fifty minutes with sawdust on him.<\/p>\n

<\/div>\n

And on the twenty-second of October a woman from an agency handed us an infant.<\/p>\n

<\/p>\n

Here is what my husband did not get and what nobody ever asked him about.<\/p>\n

<\/div>\n

He was not consulted.<\/p>\n

Not really.<\/p>\n

I want to be honest about that: on the fourteenth of October, when Dovie Mwangi asked whether we would be willing to be assessed for placement, I said yes in about two seconds and then I telephoned Hugo in a corridor and told him what I had said.<\/p>\n

And he said, “Okay.”<\/p>\n

That is it.<\/p>\n

<\/div>\n

That is the whole conversation.<\/p>\n

<\/p>\n

A man was informed, by telephone, in a corridor, that his life was going to contain a six-month-old for an unspecified period beginning in eight days, and he said okay, and then he went and bought a crib.<\/p>\n

<\/div>\n

He was fingerprinted.<\/p>\n

He was interviewed about his own childhood by a stranger in our living room for two and a half hours.<\/p>\n

He was asked, in that interview, about a period in 2015 when his business nearly failed and he was asked how he had handled the stress, and he answered, and it is in a file.<\/p>\n

He was background-checked in two states.<\/p>\n

<\/div>\n

He came to eleven of the twenty-three court dates and he sat in that waiting area and he did not bring anything to read because he is not that kind of person; he simply sat.<\/p>\n

<\/p>\n

And in eighteen months he complained approximately once.<\/p>\n

<\/div>\n

It was in the March of 2023, after the second of March, after Detective Bonaventura had taken my theory apart, and I had been unbearable for about nine days.<\/p>\n

He said \u2014 and it was not a shout and it was not even particularly loud \u2014 “Alma.<\/p>\n

I need you to notice that I live here.”<\/p>\n

I said something defensive.<\/p>\n

And Hugo said: “You’ve had a thing for four months.<\/p>\n

<\/div>\n

The thing about your sister.<\/p>\n

<\/p>\n

And I understand it and I’m not asking you to drop it.<\/p>\n

<\/div>\n

“But you have not asked me one question since October.<\/p>\n

Not one.<\/p>\n

About how I am, about the business, about anything.<\/p>\n

And I’ve been getting fingerprinted and going to court and getting up at five with a baby who isn’t ours, and I would do all of it again tomorrow, and I have not been in a conversation in this house in four months.”<\/p>\n

<\/div>\n

He was completely right and I had not noticed, which is the entire point of the complaint.<\/p>\n

<\/p>\n

We went to two sessions with Imogen Achara together in the April and he said almost nothing in the first one, and in the second one she asked him a question I would not have thought to ask, which was what he thought was going to happen.<\/p>\n

<\/div>\n

And he said: “I think she’s going to stay.<\/p>\n

And I think if she goes back, Alma won’t recover from it, and I don’t know how to be useful in either of those and nobody has ever asked me which one I want.”<\/p>\n

Then he said: “I want her to stay.<\/p>\n

I’m not supposed to want that and I do.”<\/p>\n

<\/div>\n

There is a thing about kinship caregivers that Dovie Mwangi’s training day says out loud and that I had never heard anywhere else.<\/p>\n

<\/p>\n

The relative who takes the child is usually asked.<\/p>\n

<\/div>\n

The relative’s spouse is usually informed.<\/p>\n

And that spouse then does approximately the same amount of work, gets approximately none of the moral credit, cannot complain because the child is not theirs and because the whole household is organized around a catastrophe, and is frequently the person who quietly falls apart in year two.<\/p>\n

Hugo did not fall apart.<\/p>\n

He got quiet in the second winter and I noticed, because he had told me to, and we did another four sessions.<\/p>\n

<\/div>\n

Esme calls him Papo.<\/p>\n

<\/p>\n

She arrived at it herself somewhere around two and a half, out of nothing, and the first time she did it he went out to the garage for about four minutes.<\/p>\n

<\/div>\n

He was fitting a condenser in a house in Berwyn in the June of 2024 when the guardianship order was entered.<\/p>\n

I texted him a photograph of the order.<\/p>\n

He wrote back:\u00a0ok. can you get chicken<\/em><\/p>\n

And then, about eleven minutes later:\u00a0im really glad<\/em><\/p>\n

Part Twenty-Five: My Sister<\/strong><\/p>\n

<\/div>\n

Perla left Curtis in the November of 2024, three months into his sentence.<\/p>\n

<\/p>\n

She filed in the January of 2025 and it was final in the September and he did not contest anything, and she has an apartment in Glen Ellyn \u2014 not the one in the photograph, a different one, one bedroom, on the second floor.<\/p>\n

<\/div>\n

Two years too late.<\/p>\n

I want to write this part very carefully, because it is the thing in this account that I cannot make come out right and I have stopped trying.<\/p>\n

The permanency goal changed in the November of 2023.<\/p>\n

Private guardianship was entered in the March of 2024.<\/p>\n

I am Esme’s guardian.<\/p>\n

Perla did the thing in the November of 2024.<\/p>\n

<\/div>\n

She did exactly what the service plan had asked her to do in the January of 2023, twenty-two months late, after the court had already moved, and there is no mechanism anywhere in that system that runs backwards.<\/p>\n

<\/p>\n

She could petition.<\/p>\n

<\/div>\n

A guardianship is not adoption and it is not permanent in the way people think; it can be modified, and a parent can come back to court and show a change in circumstances, and some do, and it works sometimes.<\/p>\n

She has not.<\/p>\n

I have told her twice, in writing, through the therapist in Elmhurst, that I would not oppose an increase in unsupervised time and that I would say so to anybody.<\/p>\n

<\/div>\n

She has not filed.<\/p>\n

<\/p>\n

I asked her why, in the January of this year, in that room.<\/p>\n

<\/div>\n

And my sister said: “Because I’d have to sit in front of a judge and explain why it took me two years.<\/p>\n

“And the true answer is that I couldn’t have a four-minute conversation.<\/p>\n

And I’m not going to say that in a courtroom and I’m not going to lie about it either, so I’m not going.”<\/p>\n

She sees Esme every other Saturday, unsupervised now, for the day, and she has done for about a year and a half, and it has never once gone wrong.<\/p>\n

<\/div>\n

She is, by every observation I have, a good mother for those days.<\/p>\n

<\/p>\n

She is patient in a way I am not.<\/p>\n

<\/div>\n

She does the thing with the hair that I cannot do.<\/p>\n

She has never once been late and she has never once tried to keep her longer and she has never said one word to that child about any of it.<\/p>\n

And when she brings her back she stands on my porch and does not come in, because she will not come into my house, and we have a conversation about a nap and a snack that lasts about ninety seconds, and then she gets in a car.<\/p>\n

<\/div>\n

She has not been inside my house since the twenty-second of October 2022.<\/p>\n

<\/p>\n

I have asked twice.<\/p>\n

<\/div>\n

She said no both times, kindly, and the second time she said: “Alma, my daughter lives in there.”<\/p>\n

Our parents have Sunday lunch and we both go, and it is fine, and I would describe our relationship as courteous.<\/p>\n

She has never forgiven me for paragraph thirteen and I do not expect her to.<\/p>\n

She has never said so directly.<\/p>\n

<\/div>\n

What she said, once, in 2024, was: “You wrote down that I did it on purpose.<\/p>\n

<\/p>\n

In a document.<\/p>\n

<\/div>\n

With numbers on it.”<\/p>\n

And I said, “Yes.<\/p>\n

And I was wrong and I said so on the second of March and I’ve said so in a courtroom under oath.”<\/p>\n

And Perla said: “I know.<\/p>\n

And it’s in the file.”<\/p>\n

Which is true, and which will be true forever, and which is the exact thing I have spent sixteen years telling other people about their own words.<\/p>\n

<\/div>\n

Part Twenty-Six: Esme<\/strong><\/p>\n

<\/p>\n

She is four.<\/p>\n

<\/div>\n

The femur healed in six weeks, which is what femurs do in infants, because a baby’s bone is a completely different material from an adult’s and remodels in a way that adult orthopedics finds almost embarrassing.<\/p>\n

She was in a hip abduction brace for five weeks and out of it by the end of November 2022.<\/p>\n

There is no limp.<\/p>\n

<\/div>\n

There is no leg length discrepancy, which was the thing they watched for at six months and at one year and at two.<\/p>\n

<\/p>\n

There is a small scar from nothing \u2014 the fracture was closed and needed no surgery \u2014 and she has a mark on her knee from a scooter last summer that she is considerably more interested in.<\/p>\n

<\/div>\n

The ribs healed before anybody ever saw them.<\/p>\n

She is fine.<\/p>\n

I want to say that plainly and early in this part, because people brace when I get to her and they do not need to.<\/p>\n

She runs.<\/p>\n

She talks constantly.<\/p>\n

She has recently developed a theory that our dog is in charge of the house and she defends it at length.<\/p>\n

<\/div>\n

She goes to a pre-kindergarten three mornings a week and she is, according to a woman named Mrs.<\/p>\n

<\/p>\n

Okwuosa, “a lot,” which is the highest compliment available.<\/p>\n

<\/div>\n

She calls me T\u00eda.<\/p>\n

She calls Hugo Papo, which nobody taught her and which she arrived at herself at about two and a half and which ruined him.<\/p>\n

And she calls my sister Mam\u00e1.<\/p>\n

That was decided in a room by four adults and a therapist in the January of 2023 and I want it on the record that I was not the one who argued for it hardest.<\/p>\n

<\/div>\n

Marguerite Stiles was, in a family meeting, in about nine words:\u00a0she has a mother, the mother’s alive, use the word.<\/em><\/p>\n

<\/p>\n

Esme has always known.<\/p>\n

<\/div>\n

There has never been a day when she did not, because you do not reveal a thing like this, you simply never conceal it, and I had that advice from two professionals and from Imogen Achara and it is unanimous.<\/p>\n

What she has, at four, is this: she lives with T\u00eda and Papo.<\/p>\n

Mam\u00e1 lives in a different house and comes on Saturdays.<\/p>\n

<\/div>\n

When she was a very little baby she got hurt and her leg was broken and she had to wear a special brace, and it is all better now.<\/p>\n

<\/p>\n

There is a photograph of her in the brace and she has seen it and finds it hilarious.<\/p>\n

<\/div>\n

That is the whole of it and it is enough for four.<\/p>\n

What she does not have yet, and what she will get, in stages, is who and how.<\/p>\n

The plan \u2014 and there is an actual plan, written down, agreed between me and Perla in Elmhurst with a therapist present, because I have learned that agreeing things in writing is the only thing that works \u2014 has three stages.<\/p>\n

<\/div>\n

At around seven or eight, if she asks: her father hurt her when she was a baby and that is why she does not see him.<\/p>\n

<\/p>\n

At around twelve: the fuller version, including the eight hours, told by Perla, with me in the house but not in the room.<\/p>\n

<\/div>\n

And at eighteen, all of it.<\/p>\n

The file.<\/p>\n

I fought for that last one and Perla did not want it and the therapist backed me, and the argument I made is the only argument I have ever won against my sister.<\/p>\n

<\/div>\n

I said: “She is going to be able to request every page of this herself the day she turns eighteen.<\/p>\n

It is her case.<\/p>\n

Her name is on it.<\/p>\n

“So the only question is whether she reads it in a room with us or in a room without us.”<\/p>\n

Perla agreed in that session and has never gone back on it.<\/p>\n

<\/div>\n

Esme asked me a question in the car in the August, at four, out of nowhere, at right angles, the way they do.<\/p>\n

<\/p>\n

She said: “T\u00eda, when I was a baby did you carry me?”<\/p>\n

<\/div>\n

And I said, “Yes. Lots.”<\/p>\n

And she said, “Was I heavy?”<\/p>\n

And I said, “You were extremely heavy.<\/p>\n

You were the heaviest baby in Illinois.”<\/p>\n

And she laughed like a drain for about a mile.<\/p>\n

Part Twenty-Seven: Five Things<\/strong><\/p>\n

<\/div>\n

I have been asked to talk about this twice \u2014 once at a continuing education thing for court reporters, of all people, and once at a training day for kinship caregivers that Dovie Mwangi’s office runs.<\/p>\n

<\/p>\n

I say five things and they are the only useful output of eighteen months.<\/p>\n

<\/div>\n

One. Write it down before anybody asks you anything.<\/strong><\/p>\n

Not afterward.<\/p>\n

Afterward is worthless; afterward is a document produced by a person who already knows there is a problem, and everybody in that system knows how to read one.<\/p>\n

The note I typed in a parking structure on the eleventh of October is the only piece of paper in eleven hundred pages that was made by somebody who did not know there was going to be a case.<\/p>\n

<\/div>\n

It cost me ninety seconds.<\/p>\n

<\/p>\n

It is the reason my life is the shape it is.<\/p>\n

<\/div>\n

And the thing to write is not a narrative.<\/p>\n

It is times.<\/p>\n

What time did they arrive, what time did they leave, what time did the crying start, what time did you look, what time did you leave, what time did you arrive.<\/p>\n

Times and only times and whatever you actually saw, including \u2014 and this is the part I got right by accident and would never have got right on purpose \u2014\u00a0what you did not look at.<\/em><\/p>\n

<\/div>\n

Two. If you are inside a window, get your own lawyer in the first week.<\/strong><\/p>\n

<\/p>\n

It feels like an admission.<\/p>\n

<\/div>\n

It is the opposite.<\/p>\n

A person who has done nothing and has no lawyer is a person relying entirely on being believed, and being believed is not a plan.<\/p>\n

It cost me nine thousand dollars.<\/p>\n

If you do not have nine thousand dollars, a public defender’s office cannot help you because you have not been charged, but there are legal aid organizations that do exactly this and there is one in most large counties and almost nobody knows to call them.<\/p>\n

<\/div>\n

Three. Learn what the registry is before you need to.<\/strong><\/p>\n

<\/p>\n

A child protection finding is not a criminal conviction and it is not decided by a judge and the standard of proof is far lower, and it can end a career, and most people in this country have no idea it exists until it is on them.<\/p>\n

<\/div>\n

If you are ever notified that you have been indicated, there is an appeal and it has a deadline and the deadline is short and it is in the letter, and people miss it constantly because the letter arrives in the worst month of their life.<\/p>\n

Four. Bring them facts. Do not bring them a theory.<\/strong><\/p>\n

This is the one I get wrong in front of an audience every time, because it requires me to describe paragraph thirteen, and I do describe it, and it is unpleasant.<\/p>\n

<\/div>\n

Everything in my six pages was true except the part I wrote myself.<\/p>\n

<\/p>\n

Twelve sourced facts and one conclusion, and the conclusion was the only thing that was ever used against anybody, and it was used against me.<\/p>\n

<\/div>\n

Investigators are not short of theories.<\/p>\n

They have theories the way a hospital has blankets.<\/p>\n

What they are short of is a person who saw something at a specific time and can say so without adding anything.<\/p>\n

That is a whole job and it is the job I have had for sixteen years and I could not do it for one afternoon when it was my own family.<\/p>\n

<\/div>\n

And five, which is the one I actually came to say.<\/strong><\/p>\n

<\/p>\n

If somebody hands you a child and says\u00a0you decide<\/em>\u00a0\u2014 if a relative drives a long way to give you a baby who is not right, and tells you that you have always been the one who knows when to act \u2014 that is not a compliment.<\/p>\n

<\/div>\n

It is a transfer.<\/p>\n

It may be an entirely unconscious one.<\/p>\n

My sister does not remember saying the sentence and I believe her.<\/p>\n

It does not matter.<\/p>\n

Somebody has just moved a decision from their hands into yours, and the reason they have done it is that they cannot make it, and the reason they cannot make it is usually that they already know the answer.<\/p>\n

<\/div>\n

Take the child.<\/p>\n

<\/p>\n

Obviously take the child; take her straight to a hospital, which is what I did and which is the one thing in this whole account I would not change.<\/p>\n

<\/div>\n

And understand, while you are putting her in the car, that you have just been handed something heavier than a baby, and that you will be inside it for a very long time, and start writing down the times.<\/p>\n

Part Twenty-Eight: What I Do Differently<\/strong><\/p>\n

I still work.<\/p>\n

I did three hundred and eleven days of proceedings last year, which is a lot, and I am still the person a firm asks for when the transcript is going to matter.<\/p>\n

<\/div>\n

Two things changed and neither of them is what anybody expects.<\/p>\n

<\/p>\n

The first is that I cannot sit through a certain kind of answer anymore.<\/strong><\/p>\n

<\/div>\n

There is a thing witnesses say.<\/p>\n

They say:\u00a0I’m absolutely certain.<\/em>\u00a0Or:\u00a0I remember it perfectly.<\/em>\u00a0Or:\u00a0I’ll never forget it.<\/em><\/p>\n

I have taken that down, I would estimate, several thousand times in sixteen years, and it used to mean nothing to me.<\/p>\n

It was a noise a person makes before the content.<\/p>\n

In the April of 2024 I was reporting an arbitration \u2014 a commercial matter, nothing to do with anything, two companies and a warehouse lease \u2014 and a man in his sixties said, “I remember that meeting perfectly, it’s not the kind of thing you forget,” and I had to stop the proceeding.<\/p>\n

<\/div>\n

You are allowed to do that.<\/p>\n

<\/p>\n

A reporter can ask for a break at any point and nobody questions it, because everybody assumes it is the machine or your hands.<\/p>\n

<\/div>\n

I went into a corridor and stood there for four minutes.<\/p>\n

Because what I heard was a person saying something that was almost certainly not true in a tone of complete sincerity, and I had done exactly that, in a police station, four days after the worst morning of my life, about a child.<\/p>\n

It does not happen often now.<\/p>\n

<\/div>\n

It happened perhaps nine times in the first year and twice last year.<\/p>\n

<\/p>\n

Imogen Achara says it will probably keep tapering and that I should stop keeping count, which is excellent advice that I have not taken.<\/p>\n

<\/div>\n

The second thing is that I changed a training.<\/strong><\/p>\n

Our state association runs a session for new reporters and I have taught part of it for six years.<\/p>\n

It is about accuracy and it is about the machine and it is, to be honest, about how to stay awake.<\/p>\n

In 2024 I added eleven minutes to it and the eleven minutes have nothing to do with reporting.<\/p>\n

<\/div>\n

I stand up in front of about forty people who have just qualified and I tell them that they are about to spend their careers producing the most reliable document in any room they enter, and that this is going to make them arrogant about memory, and that it made me arrogant for sixteen years.<\/p>\n

<\/p>\n

And then I tell them that a verbatim record is a record of what was said.<\/p>\n

<\/div>\n

That is all it is.<\/p>\n

It is not a record of what happened, and it is not a record of what anybody meant, and the gap between those three things is where every single case any of them will ever sit through actually lives.<\/p>\n

I do not tell them about Esme.<\/p>\n

I have never mentioned my niece in that room.<\/p>\n

<\/div>\n

What I say is: “You are going to be the most accurate person in every room you are ever in, and it is going to be very easy to mistake that for being the most correct person in the room, and those are not the same and I would like you to hear it now from somebody who found out the expensive way.”<\/p>\n

<\/p>\n

Four people have come up to me afterward over two years and asked what happened.<\/p>\n

<\/div>\n

I have told two of them.<\/p>\n

And there is a third thing, which is not a change so much as a debt.<\/strong><\/p>\n

In the October of 2024 I reported a two-day medical conference in Rosemont \u2014 reporters do that work, it pays well and it is tedious \u2014 and Dr.<\/p>\n

Halima Bright was on the programme for a session on the second afternoon.<\/p>\n

<\/div>\n

I did not know until I opened the agenda in a car park at seven in the morning.<\/p>\n

<\/p>\n

I sat behind a machine for fifty minutes and made a verbatim record of a woman explaining, to about two hundred pediatricians, the healing timelines of infant fractures and the specificity of posterior rib injuries, using a set of films that were not my niece’s.<\/p>\n

<\/div>\n

And afterward I waited by a table with a coffee urn on it for eleven minutes like a lunatic, and when the last person had finished with her I said: “Dr.<\/p>\n

Bright.<\/p>\n

I don’t expect you to remember me.<\/p>\n

October 2022.<\/p>\n

Femur and three ribs, six-month-old, the aunt with the note.”<\/p>\n

And Dr. Halima Bright said, immediately: “Restrepo.”<\/p>\n

<\/div>\n

I said that I had never thanked her.<\/p>\n

<\/p>\n

And she said: “You don’t thank me.<\/p>\n

<\/div>\n

I want to be clear about that and I’m not being modest.<\/p>\n

I read films.<\/p>\n

If your niece had rickets I’d have written that instead and you’d have been furious with me.<\/p>\n

“The only thing you should take from me is that a doctor looked at the images and not at the family, and that is the entire value of the job, and the day I start looking at the family is the day I should stop.”<\/p>\n

<\/div>\n

Then she said: “How is she?”<\/p>\n

<\/p>\n

And I said, “She’s four and she’s a lot.”<\/p>\n

<\/div>\n

And that woman, who has spent eleven years looking at the worst films in medicine, laughed like a drain in a conference centre in Rosemont.<\/p>\n

Part Twenty-Nine: Precise<\/strong><\/p>\n

My sister used the word first.<\/p>\n

It was in the November of 2022, in a corridor at the DCFS office in Maywood, after a supervised visit, and she said: “I just need you to be precise when you talk to them.”<\/p>\n

<\/div>\n

And I said: “I will be precise.”<\/p>\n

<\/p>\n

I said it coldly and I meant it as a threat and I have thought about it approximately once a week for four years.<\/p>\n

<\/div>\n

Because I was.<\/p>\n

That is the thing.<\/p>\n

I was precise.<\/p>\n

I recorded everything.<\/p>\n

I preserved the eleven words in the doorway with a fidelity that my own sister cannot match.<\/p>\n

I have times and dates and verbatim quotations and a contemporaneous note with metadata, and every single word of it is accurate, and I have never once misquoted anybody in this entire account or anywhere else.<\/p>\n

<\/div>\n

And I was wrong about the only thing that mattered, for four months, and I put it in writing with numbered paragraphs.<\/p>\n

<\/p>\n

Precision is not the same as being right.<\/p>\n

<\/div>\n

I have known that as a technical proposition since I was twenty-two years old and I did not know it as a fact about myself until I was thirty-nine and a detective in a room on Harrison Street took twenty minutes to explain it to me.<\/p>\n

People ask me whether it was worth it.<\/p>\n

They mean: was it worth losing my sister, and putting my parents through eleven weeks of thinking I had destroyed the family, and six months of a pending finding, and nine thousand dollars, and three hours and twenty minutes on a stand being taken apart by a competent man.<\/p>\n

<\/div>\n

And the question is wrong and I have stopped answering it politely.<\/p>\n

<\/p>\n

I did not break Esme’s femur.<\/p>\n

<\/div>\n

I did not break three of her ribs in September.<\/p>\n

I did not look at a leg at half past six in the morning and give a child Tylenol and cancel her grandmother and drive forty-one minutes.<\/p>\n

Nothing was lost that I had.<\/p>\n

What happened is that I found out what was already there, in a house eleven miles from mine, and the finding out is the part people want to call the damage because it is the part with a date on it.<\/p>\n

<\/div>\n

But there is a thing I got wrong, and it is mine, and it has nothing to do with the conspiracy I built.<\/p>\n

<\/p>\n

I have gone back to nine forty-one in the morning on the eleventh of October perhaps four hundred times now, and I always go for the same reason, and it is not the theory and it is not the window and it is not the eleven words.<\/p>\n

<\/div>\n

It is that my sister stood on my doorstep holding my niece and I looked at my sister’s face.<\/p>\n

Thirty seconds.<\/p>\n

Maybe less.<\/p>\n

A woman in a coat in a doorway, in a hurry, talking about a shopping centre, and I watched her mouth because she was the one talking, and there was a six-month-old in a fleece sleeper eighteen inches below my chin whose left leg had not moved since two o’clock that morning.<\/p>\n

I am not responsible for that.<\/p>\n

<\/p>\n

Imogen Achara has been extremely firm with me about it and so has Hugo and so, once, in a corridor, has Dovie Mwangi, who has no reason to be kind to me.<\/p>\n

<\/div>\n

Nobody looks at the baby.<\/p>\n

Everybody looks at the adult.<\/p>\n

It is what people do and it is not a failing and there was nothing in those thirty seconds that would have changed one thing about that femur.<\/p>\n

I know all of that.<\/p>\n

And a friend of mine dropped her son off at my house in the June, for two hours, an entirely ordinary Tuesday, a perfectly well three-year-old with a scooter helmet under his arm.<\/p>\n

<\/div>\n

And she stood in my doorway and started telling me something about her afternoon.<\/p>\n

<\/p>\n

And I crouched down.<\/p>\n

<\/div>\n

I did it before I decided to.<\/p>\n

I crouched down on my own front step in front of a boy I have known his whole life and I looked at his face and I said, “Hello, Iggy.<\/p>\n

How are you doing today?”<\/p>\n

And he said something about a lizard.<\/p>\n

<\/div>\n

And his mother said, “Sorry, am I in the way?”<\/p>\n

And I said, “No. Not at all. Carry on.”<\/p>\n

And I stood up.<\/p>\n

I do it every time now.<\/p>\n

<\/div>\n

Every single child, every doorway, for four years.<\/p>\n

It takes about four seconds and it has never once been necessary and it is not going to stop being necessary, because the one time it was necessary I did not do it, and a record of what people said turned out not to be a record of what happened.<\/p>\n","protected":false},"excerpt":{"rendered":"
