In the city of Manor, Texas, Erin McCleskey, a 36-year-old certified process server from Austin, embarked on a journey to serve court papers but unfortunately did not make it back home. 

Erin entered the property of Donald and Terry Swanson by opening the front gate—a place she had reportedly visited twice before, as reported by KVUE. However, Terry Swanson claimed that Erin made a fatal mistake by trespassing while they were away for a month.

With no one present, the six swansons’ dogs attacked Erin aggressively. The autopsy findings indicated that one of her arms had a severed main artery due to the dogs, and she endured intense pain for about ten to fifteen agonizing minutes before passing away. The medical examiner determined that all six dogs were present during the assault. 

While the owners were away, a trusted friend took charge of feeding and watering the dogs. On the same day, the temporary caretaker stumbled upon erin’s lifeless body in the front yard following the brutal assault. The authorities confiscated the six adult dogs that were involved in the attack. Furthermore, 14 adorable puppies that were discovered on the property were eventually welcomed into loving homes. 

The neighbors had previously cautioned that the canines were hazardous. Gonzalo, the owner of a parking lot nearby, shared that a few months ago, the dogs had escaped and attacked other animals, including his own dogs.

Despite dialing the emergency number, his grievances remained unresolved. Similarly, another neighbor, Teodoro Vences, reported incidents of violence against his poultry. 

Christi, a resident of the local community, voiced her worries about her children’s well-being, highlighting the persistent problem of stray dogs in the area since she relocated. Because she was concerned about dog bites, she limited her children’s outdoor activities.

Despite these complaints, the city of Austin does not have any official record of animal-related complaints regarding the property or dogs. Patricia Fraga, the spokesperson for Austin city, mentioned that the tenants’ concerns were regarding the dogs causing disturbances, but no official measures were implemented. According to the daily mail, the dog owners will not be held accountable for Erin’s death, as they did not intentionally provoke the dogs or give them orders to attack her. 

The group of six dogs involved in the attack comprised of two husky-australian cattle dog mixes and four lab-pyrenees mixes. They were held in the city’s custody, awaiting decisions on whether they posed a threat to others or should be put to sleep. 

The case took a disturbing turn when, more than a year after the court ordered euthanasia, five out of the six dogs were still alive at the Austin animal center. One canine had succumbed to heartworms, not euthanasia. The swansons’ lawyer, Eric Torbeson, who volunteered his services without charge, advocated for the dogs to have a legal hearing in order to secure their lives.

Torbenson expressed, ‘while the loss of a human life is devastating, Erin decided to enter the property without authorization.’ These dogs are regarded as beloved companions, not as killers. The video footage displayed the dogs engaging in a calm manner with the staff at the animal center. 

A professional in animal behavior recommended euthanasia, cautioning about the potential for unpredictable behavior and the possibility of future attacks. Torbeson advocated for the dogs’ return to their owners, highlighting their ability to make choices and possess intelligence. 

‘predicting when an animal might seriously harm someone else is unsafe,’ torbeson said, also voicing concerns over the dogs’ declining health due to prolonged confinement 

Claire Carter, a seasoned prosecutor specializing in animal abuse cases, partially concurred, deeming the prolonged detention ‘unjust.’ Nevertheless, she also criticized the lengthy appeals process as a squandering of time and resources. Carter asserts that euthanasia is essential to safeguard community well-being.

‘to safeguard the public and minimize unnecessary suffering for the animals, euthanasia is the appropriate course,’ carter concluded 

In addition to the dogs, the legal delays have also caused additional burdens. The city of Austin estimates that the daily care cost for a single dog is $39.75, which amounts to nearly $116,000 annually to maintain the animals, a cost that is continuously increasing. 

Erin McCleskey’s family believes they have been unfairly treated, as they see it as a miscarriage of justice. They also express concern about the impact on taxpayers and other animals due to the diversion of resources. 

Ultimately, many argue that when an animal causes harm to a person, it should no longer be considered a ‘pet’ and should be humanely euthanized to ensure public safety.
